• Wrong EMI being charged

My colleague had a loan from one of the nbfc and the principal was paid in full in june 2019.
Still now in oct they are claiming that i have an additional outstanding of 7.5 lakhs and demanding me to pay
They are not accepting its there fault and trying to bully me

You can make complaint in RBI ombudsman officer against bank. And kindly provide all details to them from applying loan till closing and all terms and conditions plus interest rate charges etc.

Detailed statement of accounts must ha e been forwarded to you every year reflecting amount due and payable 

 

2) if entire amount was paid in June 2019 you must have letter from the company that full loan amount has been paid 

 

3) no need to bow down to pressure tactics

Tell them to provide statement.

Only principal has been paid, what about interest ? Or paid outstanding - principal + interest.

- Since, you have paid the principal amount , then you should ask for no dues certificate from the said bank. 

- You can send a legal notice to the bank after enclosing all the proofs of payment ., and if continue to demand then file a complaint against the nbfc to its head office and the RBI.

When you take loan then repaying Principal amount is not enough.  You will have to pay interest as well.

Once you pay both components then you would get No Dues Certificate as well. 

Therefore clarify what is your present position on this.

You collect the evidences for full repayment and the receipt given by NBFC acknowledging the loan repayment. 

Send them a legal notice along with the copies of the receipts or other details and inform that since you have already repaid entire loan amount,  they are required to issue a  no due certificate. 

Failing to respond you may drag them to consumer forum for relief and remedy.

  2. if the needful is not done despite service of the legal notice, you can file a consumer complaint as per the provision of the latest amendments,

have you reconciled the account statements pertaining to this loan account

plz apply for it and demand a reconciliation immediately and see how they respond

if they do not respond positively then you will have to escalate the issue to the banking ombudsman

First collect the statement from the NBFC and  check you are a defaulter or not .  If you are right then send a complaint  to NBFC . If they are  stick on their claim then take further remedies.

To approach the Office of the concerned Banking Ombudsman for redressal of your grievance/s.  All NBFCs have in place a Grievance Redressal Officer, whose name and contact details have to be mandatory displayed in the premises of the NBFCs. The grievance can be taken up with the Grievance Redressal Officer. In case the complainant is not satisfied with the settlement of the complaint by the Grievance Redressal Officer of the NBFC, he/she may approach the nearest office of the Reserve Bank of India with the complaint. The details of the Office of the Reserve Bank has also to be mandatory displayed in the premises of the NBFC.

If full payment is made in June, 2019 No Due Certificate might have been obtained from NBFC. 

Ask for account details, check the account  statement. 

Payments made against loan and adjustments made by NBFC.

Seek explanation with respect to demand of 7.5 lakhs by NBFC.

If any discrepancy is found, issue notice and  lodge complaint.
