• 100 rs stamp paper with notary and witness is valid for divorce

Hello sir 
Ajse 3 saal pehle meri sister ne ek ladke ke sath love marriage kiya tha .halaki hamari family ko nahi malum tha .jab hamko pata chala ki meri sister ne love mrg kar liya hai to humne 45 din pehle us ladke or uske pitaji ke samne 100 rs ke stamp paper  par notaray vala  divorce karvaya tha ....now abhi unke vakil through vo ladke ne notice bheji hai ki apne divorce dara ke dhamka kar karvaya hai is liye valid nai hai ..or family court me jane ke liye bola hai usne .baad me humne bhi us notice ka javab vakil through diya hai meri sister apse love nai karti thi ..esa etc ..likh kar bheja hai notice ka javab ...
Now esi halat me hum kya kar sakte hai or vo kya family court me ja sakta  hai ..or kya court a 100 rs vala stamp paper divorce kabul karegi ya nahi ..or nahi kare to age humko kya karna chahiye. Or meri sister ko uske sath nahi bhejna hai meri family ko .
Plz help ..
Meri sister or vo ladka dono patel hai or gujarat ahmedabad se hai ...

A marriage can only be lawfully be dissolved by a decree of divorce granted by a competent court of law and no agreement made on arS.100/- stamp paper can legally break  a marriage.

1) " 100 rs ke stamp paper  par notaray vala  divorce" ka koi manyata nahi hei. yah bilkul koi kaam ka nahi hei. sirf aur sirf court se hi aapko divorce prapt hota hei.

2) Pati ko apni patni ko vaapas bulane ke liye kai tarike kaanoon mei upalabdh hei.unlog family court aur criminal court me complaint daakhil kar sakte hei.Kyuki ve dono baalig hei aap jabardasti ka prayog nahi kar sakte aur aapko kaanoonan koi madad nahi mil payega.

3) Agar aapki sister bhi divorce chahti hei to family court me petition file karna chahiye. aapko vakil karna hoga jo zaroorii batein aapko samjhayenge aur aavashyak steps lenge.

Divorce nhi hua hai kanooni roop we divorce lens ke liye family court me divorce ka case dalna padega agar aapki sister divorce chahti hai to.

A notarised divorced deed on  Rs. 100/- NJS paper is invalid in the eyes of law.
If your sister is not willing to live with him anymore, she can file a contested divorce on the grounds of desertion for a period more than two years and cruelty for which the documentary evidence shall be this divorce deed.
This notarised divorce deed shall be an evidence for their separate living for more than 3 years and helpful for getting divorce.

Your sister can ask him to give consent divorce on the basis of the notarised divorce deed already existing with them.
If he is not willing to give his consent for divorce on mutual consent grounds she can file a contested divorce case before the court.
The evidence of notarised divorce deed  shall be helpful for her get a divorce decree in her favor.

After receiving the summons she has to appear before the court and challenge the RCR case filed by him on the basis of existing notarised divorce deed.  In her counter or written statement she can frankly express her unwillingness to rejoin him an can elucidate the facts due to which the divorce deed was agreed upon by both. 



 

Or hum kya kare to vo ladka bhi divorce ke liye maan jaye . Ese to usne 100 rs stamp paper par divorce diya hi hai .lekin adalat me lena baki hai .
You have to ask him to apply for divorce petition before court under mutual consent for dissolution of their marriage by a decree of divorce by court of law. 




Kya meri bahen vo ladke or uske family par kya cases kar sakte hain ..
Or kitne time me divorce meri bahen ko mil jayega 
If your sister want to tke revenge on them, she can file false dowry harassment or false DV case so that they will come for negotiation and sign papers for MCD, then the matter will be disposed within 6 months.
