• Wrong Date of Birth

Dear's,

Need your guidance as to how to go about the following case:
My date of birth provided to school is wrong, date provided is 6/7/1972 wherein actual date of birth is 6/4/1974. As my dad left us in 2003, not sure it was registered in local municipal office.
School leaving certificate DOB has become the base since then including my passport.
Am an NRI and i would like to correct this now as am loosing out on some points for my migration to other country due to my wrong date of birth provided during those days.
What should I be doing now step wise, if you could guide me. thanks

What's your date of birth on your birth certificate? If your birth certificate reflects your correct date of birth, get your incorrect DOB rectified from all your docs on the basis/strength of your birth certificate.

you need documentary evidence to show that your date of birth is 6/4/1974

2) if you have birth certificate which reflects your date of birth as 6/4/1974. then you can file writ petition in HC to direct CBSE or your school board to change your date of birth in school leaving certificate

3)the reason being School Board or CBSE would not change date of birth in your school records unless you obtain court orders

4) you can then apply to passport authorities too change your date of birth in your passport by applying for reissue of passport

if you want to do it from India the process is inform the first class judicial magistrate about the incident over writing through your lawyer and then state why you want to change it, as the court passes the order, obtain certified copy of the same and use it for your necessities.

If you don't have a birth certificate, first of all obtain the same.

Get in touch with a local Lawyer. This will be issued by the Municipal corporation within whose jurisdiction you were born. Once you procure this reflecting your correct DOB, your may rectify all your documents.

do you have hospital discharge report ?the hospital must have issued discharge summary report of mother and child

2) on basis of hospital discharge report of your mother birth certificate can be issued

3) since application for registration is being done after many years you would need court order for issue of birth certificate

1. You can change the DOB, if you have supporting documents like., Birth certificate / Proof of birth letter from hospital In charge ... etc.,

2. If your birth was registered then you can get the copy of the birth certificate from municipal office. If it is not registered then you may need to file police complaint. Upon police verification the birth certificate would be issued. ( check with any local lawyer ) .

3. It criminal offence to have multiple DOB on documents. So, You need change it with all the documents.

** Since you are a NRI, investigations agencies would have your details in the Data bases already and changing your DOB could create problems. ( Talk to a senior immigration lawyer ) .

You can take a certificate from the hospital where you were born, it is also a conclusive proof of dob, and you can still enroll with concerned municipal , as if your wrong dob is in passport also it is a matter of concern

1. You shall have to have thee evidence showing your actual DOB like birth certificate issued by the Hospital or Municipal corporation.

2. Execute an affidavit before the 1st class judicial magistrate affirming that inadvertently your late father had recorded your wrong DOB which is required to be corrected now for the purpose of incorporating the said change in the passport and all your educational documents.

3. Once the said affidavit is affirmed, apply before the passport authority for incorporating the change in your DOB in their records.

4. Sens letters to the appropriate authorities of the Boards and Universities for incorporating the said change of DOB in their records.

1. Without the supporting evidence no 1st class judicial Magistrate will sign on your affidavit.

2. If you have no documentary evidence, arrange to be examined medically to ascertain your actual age by a Govt. Hospital and collect the medical report therefrom.

3. Thereafter try to get the aforesaid affidavit executed and affirmed based on the said medical report.

1. Since you do not have the birth certificate coupled with the fact that your date of birth on your school certificates is wrong it will be a long drawn process now for you to rectify it. You have to begin by carrying out the rectification in your school certificates. The school wont do it now, so you will have to file a suit in the court and the court will take its own sweet time to decide it.

2. UNless the DOB is corrected in the school certificate it cannot be corrected in the other documents.

How do you say that your correct date of birth is 06.4.1974, do you have birth certificate issued by the competent authority?

You cannot change the date of birth in the educational certificates or any other records at this stage without any base or authenticity.

I don't have birth certificate with me nor I know if it is registered in local municipal office. All I have been doing is using school leaving certificate as a base of my birth date. But I understand from my mother that my date of birth is 6/4/1974 and they enrolled me to school with wrong date of birth so that I could start the school early.

There is no document evidence as such on correct date of birth. How do I prove it and how should i go about correcting it.

If you dont have any evidence about your alleged correct of date of birth, you cannot establish the same before court or any authority, the law will not provide solutions to someone's whims.
