We are 800+ Apartment complex in Bngalore, registered under karnataka Society Registration Act. Society would like to hold Virtual / Zoom AGM this year due to COVID-19 Restrcition for physical assembly. My questions: 1. Are we permitted to hold virtual AGM- legally correct ? 2. How many days notice in advance be given? 3. How to handle attendance and voting for passing resolutions

1) Yes, You can hold virtual AGM on account of existing pandemic
2) You should give 30 days notice for AGM (Notice should include Zoom registration procedure). But notice should state that you will be using google forms for voting / passing resolutions/
3) Flat owners should first register on the Zoom Link and thereafter you should send secure login and password for all attendees.
4) Voting can be held using Google forms .
5) you can also hold training sessions for flat owners on how to register for Virtual AGM and also for voting using Google forms.

No law has prohibited the virtual Zoom AGM.
I am quite sure most of you and members of your Society are aware of the mechanisms of operation of virtual zoom meeting via video Conferencing.
You prepare list of members of Society and serve the agenda and notice of AGM through WhatsApp group of Society members prior to 14 days before 30th September 2020.
Its equivalent to physical meeting.
Its legal and no ordinance or Act has prohibited Virtual AGM meeting by State or Central Government Act as of today.
You have full authority to hold it and record the Virtual AGM keep it on record with one CD to the office of Registrar of the Society.
Virtual meeting can be granted as per COVID-19 to protection while keeping distance.

For attendance there is option in the zoom app to raise the hand and send the screen shot of each member to secretary for voting and attendance.
