• Received Show cause notice on why passport should not be impounded due to adverse verification

Hi,

I have received a show cause notice as to why passport should not be impounded due to adverse address verification report. The policemen when came for address verification asked multiple questions and we told him we have 2 addresses one on rent and one owned.. He understood that we stay at the rented one which was not mentioned in the passport application and gave this report.. 

Now I have to travel to Singapore in 15 days (for 3 days) due to company work.. can I sort this Show cause notice after coming back from Singapore? This is very urgent and any help will be appreciated..

Sir if show cause is issued on verification and adverse remark is there you can go but anything wrong happen or you loss your passport outside the embassy will not issue a new passport.

So You can file a reply to show cause and can once the show cause is decided and passport is verified then only you can go. So go meet the RPO in personal seek appointment resolve the issue they will work it out and they you can go.

Adverse report does not mean that you have been debarred from travelling abroad. You would be issued a SCN in case there is something adverse in terms of your documents/ police verification or you made a fake/false submission in your passport application. Even in such a scenario, you can travel abroad.

1. Since there was no misrepresentation of fact there is nothing to worry either.

2. So draft the said show cause notice with documentary proof and submit the same with the passport authority.

3 Considering the issue involved I do not find there is any scope for impounding the passport.

4. Unless the passport authority actually impounds the passport , there is no restrictions on your foreign travel.

1)Yes you can but it is strongly advised that you visit passport office first and have the issue cleared. If you don't satisfy the passport office they may impound the passport after which you will not be able to travel. 

2) If it is a genuine error and you have all the proofs of address for your current and permanent address then you can reply to the notice admitting that its a genuine error happened by you and request the concerned department officer to amend your application.

  1. As per the information mentioned in the present query, make sit clear that you have got the show cause notice for impounding of your passport.
  2. I advice you to please make a reply to it, otherwise if you don’t then they may issue a impounding notice of your passport which may create lots of problem.
  3. In the reply you need to mention everything about the incident, and I believe that your issue will be solved.
  4. Now, question comes for the speedyness then I advice you to file a Writ of Mandamus and Certiorari under Article 226 of our Constitution before the Hon’ble High court seeking relief for speedy completion of the process as otherwise if you say to quash the show cause notice then Hin’ble Judge may not entertain your petition as you have the option of lower remedy that is paaport authority.

Is it so that this show-cause notice specifies a definite time period within which you have to furnish your reply? If yes, you are advised to consult a local lawyer and draft a reply to this show cause notice and submit the same with the concerned Passport Officer.

you need to reply to show cause notice within the stipulated period mentioned in the notice

if you dont then your passport will be impounded at the immigration counter itself at the airport

you just need to reply that due to inadvertence you mentioned the address of the premises which is owned by you and not the address of rented premises

request to amend the application or for submission of a fresh application

Address given on the passport is one where your physical presence has been verified by them so you inform that nothing is adverse going to against you as you physical presence at both the places has been verified and attach rent agreement with your application which should be duly notarized by a Govt. Notary stating this fact, don't left show cause notice unanswered before proceeding to a foreign country.

option 1: Visit the Passport office show necessary available proof and take their views and obilge.

option 2: How you received the Show cause notice? Did you sign the acknowledgement? if not, you can travel and comeback to settle the issue later stating you have not seen the notice etc..

You will be given time to give reply to the show cause notice, hence if there is time for that you can go to Singapore and return and then give reply.

Or else you can send your reply by registered post explaining the circumstances that led to misunderstanding even before leaving the country for Singapore.

As of now there is no restriction to travel abroad, hence you can proceed.

You have to sort out the show Cause Notice well before you start travel otherwise you may be in trouble if your passport is compound you will be hold on the airport for further travelling and may be sent to the custody

1. You shall have to answer the said notice issued by the passport authority clarrifying your stand in the matter.

 

2. Since there has been no restriction imposed on your foreign travel and also as your passport has not yet been impounded, you can travel abroad and before that you should reply to the notice and seek a meeting on a date after you return from Singapore.

Dear Sir,

You may do that at your risk.  The contents of notice to be read between the lines and if last date given by it is expiring then send a request letter to extend such date by another 30 days without disclosing your departure to Singapur.

1. You dug your own grave by not mentioning the present address. Since you reside at the rented address you ought to have mentioned it as your present address in the passport application form.

2. Send your reply to the RPO and state that it was a bona fide mistake on your part to have mentioned the other address. 

3. Within 15 days the passport may be impounded. So address the issue immediately.

4. Get the reply drafted by a lawyer.
