• Theft in Hyundai car

Sir I used Hyundai Creta Car. I visited Pushkar fair on dated 23.11.2018 by car. Car park in place of parking place for visitors. Someone broken back side window glass and some valuable material theft from Car diggi inside the car. Hyundai car company is very large and responsible company for consumers security but I was very disappointed to see the car back side diggi not secure from inside the car 
Please advise me I can compalant in consumers Court against Hyundai company

Hello

        The car's lock and security systems were working. The glass in the car can be broken by anybody and it is the same for every car. If the thief broke the window then the security systems cannot be at fault unless the alarm didn't go off provided by Hyundai. If that is the case then you have a case.

Hello,

if you feel that proper theft mechanism as promised in the car has not been given then you may send them a legal notice and then file a case for deficiency in services.

however, since external force has been used to break the glass, you will not have a very strong case to defend.

Car manufacturer is not responsible if culprits broke  the back side window glass and stole valuable material from your car 

 

if theft has taken place in car parking you can hold the person who have been allotted car parking area by muncipal corporation and charging you for parking your car responsible

What do you mean to say, when you say that the back side diggi of your car was not secure from inside?

I hope you understand this glass was not supposed to be bullet proof. Glass window for that matter, can be breached in any car, irrespective of its make/company.

See in the circumstance the action agaisnt the hyundai cannot be taken as it was theft glass was broken it was not deficiency on part of company. if there was deficiency in you car then same can be claimed from hundai but in your condition force was used. So hyundai cannot be blamed even you go for litigation it would be waste of funds.

as you show the car verfied it and then purchased it you must be aware of its security and moreover it was glass. So donot waste time no litigation against hyundai possibe , persue the case with police and try catching thieves.

How can the thief approached in side diggi from back seat ?

If he had unlocked the doors from stairing side than diggi also unlocked.

Complaint is possible but first need to know  what mechanical benfits offered by company in car.

1. If you go to consunder forum it will be for you to prove that the car glass was made of inferior quality material due to which it could be broken so easily. This will be very difficult.

2. If you had parked your car in car parking then the responsibility to secure the car was stacked on the shoulders of the institution which was operating the parking. You should sue that institution through a complaint case in the consumer forum.

You have no prima facie case against Hyundai as the said was never advertised as an unstealable car and under no circumstances,  they can be attributed for the theft of your car.

In my opinion,  the chances of success in the aforementioned case are very meagre.

If someone Broken the side glass window is not comes under responsibility of manufacturer

If any other problem in cars security like lock of diggi you may send legal notice but you have proove the difficiency of security mechanism

You can cliam the same through negligent product defination 

However u need to count the compensation you want to demand and start with writing a letter to the company quoting that if the same is not done legal action against the company will be taken

Hello,

1) If the third broke the glass and stole valuables from your car Hyundai can't be held liable for damages in a consumer forum. You can file an FIR about the theft.

2) You can seek damages only if you have an insurance to cover you.
