• A stranger has made his passport on my address without my knowledge

I work in Dubai. I am in my 30s. My 65 year old widowed mother and I are joint owners of an apartment in Pune. 

My relationship with my mother is not the best, but I send her money every month, and we stay in touch on whatsapp. 

I recently found out that my mother had a 20 year old boy move into my house without my knowledge. He has been living there for at least 8 months. I also found out from a 3rd party that she made his Aadhar card and passport on our house address. 

Shocked on discovering this, I flew back to Pune this week and confronted this boy and my mother. Both deny that he has a passport. He showed me his Aadhar which has my address. 

Please advise me on what legal action I can take to revoke this boy's passport and Aadhar card.

Hello,

File an FIR with your police station if the boy has stated any information that is false. Like your address in the aadhaar card. If he is denying the existence of a passport then inform this too.

Also ministry of foreign affairs should also be informed through the passport sewa kendra RPO of this incident.

You should bring notice to Aadhar and passport authority in writing to remove the address in the passport and Aadhar card of said stange person by narrate in detail and they will take appropriate action in this regard. All the best.

Issue legal notice to the boy that he has illegal mentioned your address as his resident address and ask him to change same

If he doesn't.take step inform.regional passport authority and file a complaint with adhaar number.

There is nothing wrong in what this boy has done. It seems that your mother had inducted him as a tenant. A tenant can furnish his rented address as the address for the purposes of his passport and adhaar card. Under no circumstances you can initiate any legal action to revoke his passport.

The boy may be obtained Aadhaar card and passport by using your residential address. At the time of filing application he may give your place and residential address as he presently residing place. If you have any objection to use file a complaint before near police station. They will call the boy and do necessary actions against the misusing of address of other person identity. If the boy is not ready to change the address , they can file FIR under 66 (D) of IT Act. if the boy change his address you can get remedy immediately .if police refuse to lodge FIR lodge complaint with magistrate under section 156(3) to direct cops to investigate .you can also move civil court and obtain injunction restraining person from using your residential address

1. it is not clear what sort of relationship your mother may have with this man. Since she has let him into the house and allowed him to use this house as the address of this man she must have any long term plan.

2. However in her personal matters I regret you can not have any legal remedy. But since he is a stranger and the house is an undivided dwelling unit you have every right t oppose stay of this man in your own flat.

3. So to stop this man from staying in your flat anymore you can file a suit for eviction and injunction.

4. however since the situation is taking a nasty turn I would recommend you to sit with your mother and resolve this issue amicably. Her loneliness seems to be the cause for this situation take her to Dubail if you do not want recurrence of this incident.

This is my response to you:

1. If your mother has entered into a rent agreement (only if registered) with the 20 year old boy then the boy can make his current address details on the same;

2. If there is no agreement then using your address is wrong especially aadhar and passport;

3. Confront your mother and ask her what is happening;

4. If your mother and this boy do not listen then send a legal notice for eviction of this boy;

5. If he still does not respond then engage services of a lawyer file a suit for eviction in the civil court.

The fact that the boy has an aadhar card issued to him at the address of your flat, does not mean that he gets a title to your property

Similarly issuance of passport to him does not change the situation

The boy cannot claim any title to your 50% share in the flat

Without your consent no third party can live in the apartment as you are a joint owner .

In case of aadhar you should file a complaint with your local police under section 416 IPC.

You may report the same to the passport authorities by means of a letter thereupon intimating them that he is not a permanent resident of your house and therefore address from his passport be changed.

Send a copy if this letter to the local police station also.

How is he staying in that house, if your mother has permitted him to reside, then you should discover her motive behind allowing him to stay in that house.

She may be requiring a helping hand at her old age hence would have made him to reside there.

She is having equal share in the property hence her authority cannot be questioned.

If you are so much worried, then you seek partition of the house property and take possession of your legitimate share in the property.

If that boy had been permitted by your mother, then you cannot ask him to get out of the house.
