• Permission regarding appearance before civil court as witness

I m à govt employée. M'y Sister has made à court case in dowry act. In tchat case i have made à statement before court regarding présence in engagement ceremony. When i give my statement, i was on leave on account of personal work. I have not informed department as it was realy my personal and familly matter. Now i want to know that was it necessay to take permission from department before appearing as witness in my familly matter ?

Hello,

It is not necessary to inform the department if you are appearing before the court as a witness, in case had you been appearing as accused then it would have been necessary.

Also there is no problem if you inform the department about the same. Although the head of personal and family matter will cover your also.

No you were not required to take any permission in view of the fact that you in any case were on leave on that day. No need to worry at all.

No sir ,,,you are not under any legal liability to inform your department .. Since you are only a witness you can give statement and appear before court to follow the trial of your sister( if you want)..

1. If you are summoned to appear as witness in court then you must inform the court this reason.

2.While applying for leave you can inform the employer about this.This is valid reason to get leave.

1. you have to show that you was present in that ceremony then your evidence shall be admitted by the court.

2. whether you had proper permission or not is the subject matter of department and you cannot be penalised by the court in this case and also it may cause no effect on your evidence.

3. if you attended this ceremony after office hour then no action can be taken against you.

4. if you attended this ceremony in office hour and did not take leave from office then department can deduct 1/30 part from your salary.

1. You told the department that you have 'personal work'. Testifying in a court as a witness in relation to the dowry case filed by your sister is indeed a personal work.
