• Divorce paper when no copy of original

I wanted to know if it is possible to get a duplicate divorce papers in the following situation:

1. I do not have photocopy or petition number or any other identification number of original document.
2. I have the court which was Family Court in Mumbai. I had gone to fourth floor.
3. I have the date and time when I went. (year was 2008)

These are for my papers.With the above how can one get the papers again?

It is possible if you know the parties name and approximate date when you appeared in the court.

Hi

Generally all courts maintain records of disposed cases till 8 years.

Also courts maintain something called SUIT EXTRACT REGISTER and this register is available for almost all cases since independence.

So, you can always go to the concerned court and get details of your case from suit extract register and based on suit extract register, you can apply for orders copies of your case.

Either you can go to concerned court in person or appoint a lawyer in mumbai to do the work for you.

You must have engaged a lawyer to filefor divorce

2) you can request him to furnish you petition number of your divorce petition

3) further your wife must be having copy of divorce papers

4) to obtain duplicate copy you have to make application for certified copy of divorce Decree

5) for that you need the petition number of divorce petition filed , date of filing etc

6) your best option is to contact your lawyer who filed for divorce on your behalf and obtain certified copy of divorce decree

You can apply at the copying agency in court..every court has 1..contact a advocate of that perticular court.. Provide him the title(names)of both parties.the year of filing... As the family court is a special court.. It may take some time .. But he will find out..

1. For applying for a certified copy of the divorce decree, you shall have to specifically give the case no. . Otherwise it is not possible to search from the heaps of cases your record by using your name only.

2. However, if you can give the date when your divorce decree and also the Court no., it may be possible by the law clerk to find out your case number from the list of the cases appearing on that particular date, by using your name.

Ascertain the details of the case from the court registers pertaining to the year you have mentioned, after that apply for certified photo copy of the desired documents pertaining to the case.
