Me or meri wife dono patel caste se hai . Or 15/2/2013 ke din humne hindu vidhi se or register marriage kiya tha ..bad me meri wife uske ghar pe rahti thi or me mere ghar pe meri wife mujhe bol rahi thi ki vo uske ghar valo ko mana lengi .but last me nahi mane to meri wife ne mujhe mana kiya ke me apke sath ab nai reh sakri or just 30 din pehle mera divorce karvaya 100 rs ke stamp paper par .abhi mujhe meri wife ko vapis lana hai to kya karna hoga ...
Or court me 100 rs ka stamp paper par divorce valid hai .plz help me .
Me meri wife ko divorce nahi dena chahta ...kya me family court me e case long time tak chala sakta hoon...

Stamp paper pe divorce koi divorce nahin kanoon ki nazron mein. Divorce sirf court grant kar sakti hai. Aap ki marriage abhi bi valid hai for all legal and practical reasons. Agar aapki wife ko uski icha ke virudh uskey ghar mein rakha gaya hai to aap usko release karwaney ke liye High Court mein petition file kariye.

Hello,

1) No divorce is valid by making a decree on a Rs.100/- non judicial stamp paper. You being Hindus and married as per Hindu rites and rituals, only and only a court can grant you decree of divorce. For this you need to file a petition in the court.

2) The 'divorce' you have taken is illegal and invalid and therefore you continue to be husband and wife. You can go ahead and bring your wife home. Nothing stops you from doing so.

The divorce agreement on a Rs. 100 NJS is not valid as per law and not admissible as evidence in law for proof of divorce.

This may help to seek divorce in case both would like to get divorced on mutual consent grounds at a later stage.

If you do not want to give divorce to your wife, you may sen her a notice to come back live with you to continue the broken matrimonial life.

If she is not responding then you may file a RCR petition.

Hello,

1) Dekhiye aapka divorce on Rs. 100/- ke stamp paper par hua uska koi mayata nahi hei.

2) Section 13 B ke tahat apsi sahmati se divorce hota hei. Aap dono pati patni ko ek juth petition ddakhl karna padega aur 6 mahine bad court ke decree dwara kaanoonan aapke divorce ho jayega.

3) Agar aap ab bhi divorce se sahmat nahi hei to aap peeche hat sakte hei , aapko koi bhi jabardasti se kuch karwa nahi sakte.

Dear Sir, Notary divorce is not a legal divorce. You have to approach the family court and to get decree for divorce. It is the law.
