• Prohibited list property

I am planning to buy a house in Hyderabad, that survey number is in Dharani portal under prohibited property when I search with survey number. Seller has writ petition court order approval to sell those lands with the same survey number and plot number. I am worried to buy it or not, any suggestions? Thank you.

You can purchase the property as the HC has permitted seller to sell the land with survey number

Hi, Without verification of the documents, it is difficult to say whether you can buy a property on not. It is better you can get a legal opinion from the local advocate before purchasing the same.

Hello, 

  1. Even though there's a High Court order permitting sale that the seller has shown you,  you need to to take extra precaution before you proceed with the purchase. 
  2. The best course of action would be to get effect a thorough property search by a lawyer in the locality,  besides getting more details of the Court Order in question and its background. 
  3. Once the search is completed and the results are positive,  let there be mention of the Writ Order in one of the clauses of the Agreement for sale.

The writ is reported to have been decided and the vendor states that he has a favorable order, but did you get it verified through your own lawyer?

Did you obtain a proper legal opinion about the property from an experienced lawyer?

Any opinion or suggestion rendered without seeing the relevant papers/documents, may be misleading, hence it is advisable that you obtain a proper legal opinion from a local lawyer instead of getting misguided by some vague replies through such online legal forums.

- You can check the Prohibited lands list from the Dharani portal of the Hyderabad , Telangana government.

- Further,, if the seller has High court order /judgment for selling the said property with the same survey number , then you can procced for the purchase of the same 

- However, you should take the certified copy of the said order for your safety and satisfaction.

In the absence of a detailed inspection of the property documents and perusal of the orders of the Hon'ble HC, it would not be possible for anyone to tell you whether the sale of the property is prohibited or not. You should get the due diligence of the documents of the property and the order of the Court done by an advocate.

The issue is with the survey number and not with a particular plot.

You will not come to know that which is covered under prohibited list and which is not.

Why do you want to get into trouble by buying a disputed property.

You may decide to keep off from the Idea of buying this property which is not having a clear title.

It is the orders passed in writ petition that will give you clear information as to whether all plots are prohibited or only some specific plot numbers are in prohibited list notified under Section 22 A of Registration Act.
