• Want to understand the process of court marriage

Me and my fiancé are indian citizen and working abroad separately in different countries, we want to get married via court marriage without doing any time taking rituals and other ceremonies.

1. If you are Indian citizens presently residing outside India then you can get married before Indian Consulate under Foreign Marriage Act.

2. To marry in India without undergoing rituals, you have to marry under Special Marriage Act. The process begins by filing an application before the jurisdictional marriage registrar supported by personal affidavits and some photographs and two witnesses. If no objections to marriage are received within 30 days then a civil ceremony can take place before the registrar after 30 days and you will be issued the marriage certificate in 2-3 days.

Yes, you can do so by registering your marriage in India under Special or Hindu Marriage Act

If you can not travel to India then you can register your marriage under Foreign marriage Registration Act from the office of Indian Consulate or Embassy.

30 days notice of intended marriage has to be given .if no objections are received marriage can be solemnised by marriage officer of the consulate in presence of 3 witnesses

 

 

Approach consulate general for registration of your marriage under section 17 of the Foreign Marriage Act.

Court Marriage means legal authorization of marriage between two people belonging to two different religions, according to the Special Marriage Act 1954.

You can contact the Indian Embassy or the Indian consulate/High commission of your country and get the details as well as the forms or formalities to be complied in this regard and proceed with your proposal to marry your fiance.

Along with the application form for marriage you would be required to attach following documents:

1. If you both are OCI holders then copies of the same would be required while registering your marriage 

2. Copies of both of your birth certificates 

3. Copies of employment offer or recruitment enrollment certificate 

4. An affidavit stating that both of you are inclined to get married, both are of adult age and belong to same religion/distinct religion and are not enforced to take this decision of marriage. There is free consent, willingness and no coercion to enter into this matrimonial bond from either of them to other. 

5. Copies of your passports 

6. Recent Passport size photos minimum 10 in number

7. Copies of residential proof of India and respective countries you both work. 

8. If this is your second marriage then the copy of divorce decree of earlier marriage would be required 

9. In application form for court marriage they would ask whether there is any criminal case pending against you in any court of law, If you have any criminal record then you would be required to attach copies of the same. 

You are advised to keep a copy of the application form along with the enclosures attached therewith for your own records.
