• Boyfriend ditched me citing caste difference due to his parents

I have been in relationship with a guy for past four years, we have been in a physical relationship. He broke up with me since his parents said no to marriage because of CASTE difference. I'm not able to accept that reason. His mom called and threatened me. I want to let them know that they are doing things wrong. How should I handle it legally? I don't wanna defame my boyfriend because I know he tried from his end 100% to marry me, but because of his parents only we got separated. I can give up my love for caste greediness of someone else. I atleast need a sorry statement from them for speaking bad to me.

1. See you may file a police complaint in case your boy friend had physical relationship on promise of marriage with you however that is not case as per facts so for intimidation and threatening you may file police complaint against the mother and father of your boy friend.

In order to teach them a lesson, you have to drag your boy friend into this and it is his duty to convince his parents. If you have any physical relationship then you can file a case for rape for enticing you to get into relationship on the fake promise of marriage.

But if you take legal action by filing a criminal complaint against your boyfriend with the police, his parents will automatically come for compromise.

Dear Ma'am,

There is no provision where you can demand an apology for hurting your sentiments. You could have demanded apology if they had defamed you, however a private conversation (however rude it may be) does not amounts to defamation. 

There are many ways to settle scores by making a complaint for cheating, rape etc. But they have serious consequences and your ex-boyfriend can land in trouble. In my opinion taking such actions would be too harsh on him.

Do not waste your time and money.  You will not get the desired remedy from law.

Check with your Boy Friend, if he is with you, if he is with you, you can question his parents and demand apology from them. 

If you still want to continue with him, if he is also interested to do so, you can go ahead and marry without others involvement i.e., if both of you attained age of majority.

Madam,  

It is suggested to that you talk to you boyfriend and both of you can take strong decision under mutual condition. It is quite possible that his parents will bow down against your love and care for each other and later they apologize before you. At this juncture, you are suggested not to take any legal action because from your query, it is clear that he is in deep love with you and it is not his decision to say no to marriage. Also, your legal decision will hurt him for which he is not responsible.

- As per the Supreme Court,  When a man and a woman live together as husband and wife for a long term, the law will presume that they are legally married unless proved contrary.

- Further, the Protection of Women from Domestic Violence Act 2005 provides for the protection, maintenance and right of palimony to a live-in partner, if she complains.

- Hence, if you were in relationship for 4 years, then you can legally take actions against him.

- You should lodge a complaint against him and his family members before the police and higher official, after mentioning all the facts in details.

- Further, the law not grant any person to raise the issue of caste etc , hence you can file a complaint against his parents , who become the cause of detach between you both . 

- Further , if your boyfriend has interest in you , then being major he can marry with you legally without getting permission and consent of his parents.
