• Divorce Decree

Dear Sir/Ma’am, 

My divorce order is passed by the family court in Chennai (The Madras High Court) earlier this month. However I couldn’t obtain a copy of my divorce decree online. I have mentioned my ex wife as a nominee in my organisation for PF Transactions. To remove her from my profile, my organisation is asking me to submit the divorce decree. Please advise if there’s a way I can obtain the divorce decree online or can lawyers obtain a copy on my behalf ? Thanks in advance.

Dear sir,

Obtaining a certified copy of the decree is not possible online. It has to be obtained physically. 

However, a few courts provide the unofficial  copies of orders and judgments online on the E-District court website.

Select the district and court, and try to find out the details after entering the case number.

Any local lawyer would be in a better position to answer this. If the administrative section of the court is functional, then you might be able to obtain. 

I am not sure about the exact status of the courts in Tamil Nadu.

Family courts are operational and application can be filed for certified copy of divorce decree

You can obtain the order copy online from ecourts website. But for a detailed order, it has to be physically applied in the court. 

It can be applied now by mentioning the urgency clause

There is no way through online you can get certified copy of order of court. 

If your advocate was permitted to appear on your behalf in the family court then he can apply. 

Otherwise you will have to physically apply and obtain it.

You have to obtain certified copies of the order and decree from the court by filing an application for the same before the concerned court. You can engage an advocate for obtaining certified copies locally. In case the court is not functioning physically you may have to wait for a while to obtain them.

Any local lawyer can easily obtain a certified copy of the order from the court and the whole process will not take more that 2-3 days(considering the current situation). 

You may also obtain a copy of the district court concerned uploads a copy of every order on its site, but there are very few districts where this is done. Furthermore your office may demand for a certified copy which is considered as the most authentic one and in that case a internet generated copy will not suffice.

It is possible. 

You may appoint a junior lawyer who is oPracticing regularly before the Family Court Chennai for obtaining certified true copy of decree of divorce. 

Even in lockdown period every Courts through out India are functioning physically specially trial courts for urgent hearing and ad-interim orders.

You may try this.

Alternatively you may submit an affidavit, executed before competent authorities or Notary, to inform all concerned to remove the name of your wife from the records as she is no more your wife because of decree of divorce. Please make an undertaking with your affidavit that you would submit the copy of divorce decree of your wife as soon as you get from the Family Court after the lockdown and COVID-19 pandemic situations which is entire World is affected.

- Generally , court did not upload the Decree of any case online.

- Hence, you can get your copy of original decree from the court . as there is provision to provide the copies to the parties. 

- However, during the lock down you can get the certified copy of the same personally or with the help of your lawyer.

  1. You or your lawyer can apply for the certified copy from the court that passed the decree of divorce.
  2. It is possible during the lock down as the courts are functional in a limited manner. It would take longer than normal.

Copy of order passed by HC always available on court website. Or ask your lawyer to apply for certified copy. Easily will obtain.

And it is up to you to decide who will be your nominee and can change without any reason. Organization is wrongly interfering in your right appoint/replace nominee.

Normal functioning of courts is affected during the current lock-down in Chennai and in TN. Physical hearings are yet to resume. Courts are working with minimal staff. In the circumstances, you may have to wait. There is no urgency for you to change the nominee for your PF immediately, as your ex-wife cannot withdraw any money from it.

You can visit the court and pay the requisite fees and apply for the copy of a judgement and decree. You can also instruct your lawyer to get the copy of judgment and decree.

1.Yes your lawyer can obtain a copy of the decree. 

2. Court r not working in their full capacity yet if d lawyers r allow Ed in d court then your lawyer can get a copy on your behalf. 

3. Deciding nominee or changing a nominee is purely your concern. Therefore your organization cannot bound u that without d divorce copy they will not proceed further. If they r pressurising u ask them to show d rules where it is written that such thing is required to change nomination.

In the given situation it is not possible to obtain certified copies of the divorce decree  even by filing copy application.

The family courts are not having online facilities to download the judgment, hence you may have to wait for few more months.

  1. As per the information mentioned in the present query, makes it clear that you need to have the copy of the court order either certified or online through courts website.
  2. I would like to apprise you that you can get it obtain from online itself if it is available.
  3. And if not then you should file a certified copy either through your advocate or in person too.
  4. But yes, as the courts are closed, you need to move an application through your lawyer stating the urgency and requirement of direction to the court staff for uploading the court order.
