• Do I need a lawyer?

Hi,

Tenants stay on top of me have become a pain to me. I am trying all possible ways , nothing is working. Owner just don't respond to my concern. My society president also tried reaching him , he just dont pick the call. Due to their daily disturbances, my client calls are getting effected as I am not able to hear it properly. I personally feel like harassed. I stay in Whitefield, Bangalore. My president told me to take police help if needed and he is ready to help. But i never been to police station, so kind of bit tensed too. Would it be a right thing to hire a lawyer who can help on this? If so, does anyone have idea as how much they charge for these type of cases. This is for Section 268.

1. See for police station you don't need a lawyer you may go and register a complaint with the police though in case you need assistance you may engage local lawyer and charges shall be according to his services.

you can complaint against your neighbor at near by police station for creating nuisance or you can file a Civil Case against the said person seeking injunction restraining him from doing such act .

The pains caused by the occupier on upper floor is not clearly described. 

If there's noise problem the Police has nothing to do. 

Only a civil suit can help you. So file a suit for declaration and injunction. 

Another option is to file case under section 133 of crpc.

If there is a nuisance created by the upper floor neighbor and if the same is intolerable  then you may issue a legal notice to them along with a copy endorsed to to the association president to instruct the neighbor to refrain from indulging in such activities which is  disturbance and nuisance to you.

You can inform the landlord about this atrocity done by his tenant and ask him to take proper legal action to curb this menace.    

You can consult a local lawyer and cause to issue a legal notice through the chosen lawyer.

You can enquire about the lawyer's fee from the lawyer itself.

Yes, you can make complaint against him in the nearest police station not require any lawyer. But for Sec 268 of punishment charges are just 200 rupees.

 

So this is not proper solution, Instead take the help of Society President for Nuisance and make the complaint to society body, society body is also not listening then do make complain against society body to Sub-Registrar of Co-op Housing society of your area.

- Firstly give a written complaint before the president of society , and further request him to lodge a complaint against the said tenants before the police for lodging an FIR under section 133 of CrPc.

- If no response, then file a complaint before the magistrate .

- Further , you can also file a Suit for Mandatory Injunction for permanently stop the said nuisance.
