1. Send a legal notice to your uncle to handover the property which is yours. If he also has a right over the property, ask him to agree for partition of the property.

2. If the problem is not resolved, file a case in the jurisdictional competent court for partition, declaration and separate possession of the property by metes and bounds.

Dear Sir,

If all documents are standing in your name just go to the police station and they will call and settle the matter if you manage the police. Secondly if it is not possible then approach local leaders who are supporting you. Finally you may approach civil court get file a suit for recovery of possession. You will succeed.

Do you have the property documents on your name

If so then you can file an injunction suit against them to eject them from the property and to retrieve possession of the same by filing the suit before the appropriate court.

Hi

If the land is mutated or registered in your name, then you should file a suit for

a) Declaration of title and restoration of possession under Rule 7&8, Order 7 CPC and

b) Also claim for mesne profits(earnings derived by your pedda naana) during his possession of your property under  Section 2(12) of CPC.

Steps:

1) First issue notices to your pedda naana staking your claim on the property

2) Then file the suit in the local court having pecuniary and territorial jurisdiction over property.

Hope this information is useful.
