• Registering POA in Jaipur for registering the property in Bangalore

My property in Bangalore is being bought by person working and living in Jaipur. The property is being sold to the son and his Mother. The Mother lives in Bangalore and the son is in Jaipur. Because of the Pandemic, the son is afraid to travel to Bangalore because of quarantine requirements that keep changing without proper notice. even though Bangalore quarantine rules does not require Quarantine for Business travellers and as long as one has 7 day return ticket to point of origin the buyer is afraid of quarantine rules when he returns to Jaipur
Can the son give POA to his Mother without the Mother being present in Jaipur ?
I (the seller ) have no problem getting the POA endorsed here in Bangalore by the proper authorities.

1. Yes on the basis of power of attorney the person can delegate his power of selling to someone else.

2. However in such cases POA is to be registered and in favour of close relations like mother in your case. 

3. So you can proceed with sale once those formalities are fulfilled.

A. In order to receive or purchase the property that GPA executed by his son from Jaipur is sufficient document subject to payment sufficient stamp duty. As the GPA transaction is going to happen with in the family no registration is mandatory. However registration of GPA is always good in the eyes of law.

B. Mother can represent the GPA holder to purchase the property in favour of herself and son. Hence, son presence is not required before sub registrar office in the presence of GPA.

C. Sin can execute a GPA on sufficient fee paid Stamp Papers with signature and mother should sign the same once received at Bangalore. Therefore mother need not go to Jaipur as well son not required to come to Bangalore either GPA or Sale transaction.Rs.200/- stamp paper is enough in Karnataka.

- Since, your property is based in Bangalore , hence the buyer should registered the property here and not Jaipur.

- Further , as the property is being sold to the son and mother , then the son should execute SPA/POA in favour of the mother or any relative based in Bangalore for the said purpose , if he is unable to appear. 

- Further , the presence of mother in Jaipur is not required  for registering the SPA/POA in her favour. 

- For the execution of SPA/GPA , only executor appearance is mandatory before the Registrar or competent authority , and that is the reason this tool is mostly used by the persons , who are based out of India.

Yes execution of POA at Jaipur for the property at Bangalore buying purposes is legal and valid subject to the verification process of Bangalore competent authorities.

1. Now a days, POA is required to be registered for enabling the POA holder to sign the sale deed in his favour as the buyer.  

 

2. For registering the POA the executor shall have to be present before the Registrar.

 

3. So, both the son and the mother shall have to be present before the Registrar at Bangalore for registering the POA.

 

4. If the son can come to Bangalore for registering the POA, he can very ell register the sale deed along with his mother.

1. The said POA can be registered either at Jaipur or Bangalore for which both the son and the mother shall have to be present before the Registrar at either of those two places.
