• What legal action can be taken against cruel wife?

Hello to all. maine Sep 2017 me divorce file kiya tha. In return wife ne dowry case kiya Oct 2017 me. then May 2019 me mere papa par 2 bar attemp to rape,molestation ka jhutha case kiya. Ashleel video banane ka bhi aarop lagaya. Aaj bhi wo mere papa ke hi ghar me rehti hai. 2 flats aur hamare sare saman par kabja kar rakha hai. bolti hai wo sara samaan apne sath dahej me layi hai. wo ghar meri late dadi ke naam pe tha. unki maut ke baad papa ne apne bhaiyon ke sath mutual agreemt se batwara kiya aur ab ye ghar unke naam par hai but tax & muttation receipt me abhi dadaji ka naam hai. problem ye hai ki meri wife hume wahan shanti se rehne nahi deti hai. most of the time meri maa akeli rehti hai wahan. meri wife unke sath gali galoz, dhamki dena, ghar me upar ke floor pe nahi jane dena, maa ke upar kachda, urine fekna jaise harkaten karti hai. unko torture karne ke liye jo kar saktihai wo sab karti hai. inn sab me uske bhai aur bhabhi uska support karte hain. hume uksaati hai apni harkaton se aur jubaan se ki hum gussa hon aur kuchh kar baithen uske sath. 

1. wo uss ghar me rahi to koi bhi chain se nahi jee payega. humne koshish ki mutually kuchh arrangement karne ki but wo ready nahi. use ghar se nikalne ke liye kya kiya ja sakta hai? kuchh aisa hai jisse ghar me shanti ho sake?

2. main aur papa uss ghar me nahi rehte. soch rahe hain ghar bechne ki. usme bhi wo problems kar rahi hai. abhi SDO ya SDM ke paas jaa kar property me apna hissa manga hai. police ne hamare ghar ki details bhi li hai. humne socha tha wo ghar chhor kar kahin aur rahenge but darr lagta hai wolog kabja kar lenge fir salon tak case ladna padega. koi legal way hai jise follow kar use kabja karne se rok saken?

3. ek saal pahle family court me usne jhutha affidavit diya tha jisme mention kiya tha ki main monthly 2 lac earn karta hun various sources se. ye bilkul jhuth hai. jan 2018 se jobless hun main. papa ki salary ke alawa 2 flats ke rent se ghar chalta hai. jhutha affidavit dene ke liye kya aaj perjury ka case kiya ja sakta hai? Sec- 340, 182 banta hai?

4. Divorce hoga to jaan se maar dene ki dhamki di. divorce wapas lene k liye force karte hai. mujhe n family ko badnaam kiya hai society me jhuthi khabren faila ke. papa ke govt office me ja kar unke bare me jhuthi khabre failayi, unhe kaam aur salary se 1 saal tak door kiya. papa ki posting huyi to new jagah par bhi pahunch kar yahi sab kiya. sec- 499, 506,504 banta hai?

5.maine suna hai ki jhutha cases file karne ke 3 years ke andar defamation case file kar sakte hain. to kya abhi karna chahiye? kya usne jo jhuthe case kiye hain sazish kar ke uske liye FIR kar sakte hain?

Uske sath rehna possible nahi. hum shanti se rehte huye cases ladna chahte hain. isliye ab tak ignore kar rhe the but ab jyada ho rha hai.

kindly tell me every possible options please.

Your father can file case before senior citizen tribunal seek court orders directing you and your wife to vacate portion of house in your possession 

 

2) seek permanent injunction restraining you and your wife from disturbing his possession of the house

 

3)you have no share in property during your father lifetime 

 

4) you can  file case for perjury against wife under section 340 crpc

5) yourcan also file case of defamation against wife under section 500 of IPC for maligning his reputation

Your mother can file the counter cases on her and her bhaiya bhabhi and also father can file the eviction suit. Also file the criminal case of defamation, blackmailing etc. against her. The best way is to irritate her by way of litigation and get the police complaint done by mother on every occasion when she does some misdeeds.

File private complaint (not FIR) u/s 156 crpc before magistrate for offence under  section 182 and 211 of IPC.

File separate private complaint before magistrate for defamation u/s 500 IPC. 

Also can file defamation case in civil court and claim compensation. 

File another private complaint before magistrate for extortion under section 389.

File two three criminal cases against her. She will face the music. If you keep silent such  things shall always have tendency to grow day by day.

You can file a divorce case against her. You parents can file case under senior citizens Act and evict her if she is forcibly staying. I would advice you to file an application under section 12,18, 19,20, 21 and 23 of  D V Act 2005 against your wife and claim right of residence in the same house which is under her possession. 

I would advice you to claim maintenance under section 24 and 25  of HMA  1955 from your wife for the reasons you being unemployed and can't survive without the help of your wife at present. 

File an application for quashing Criminal case under 482 Cr.P.C.1973 before High Court making your wife as Respondent No 2 .

File a Criminal case against your wife under section 211 of IPC before Magistrate Court for prosecution. 

File application under section 9 of HMA Act 1955 against your wife for RCR .

You may go ahead for prosecution  before the Magistrate Court under section 500 of IPC against your wife.

Appoint private detective for evidence against your wife for use of it before Trial,Family and High Court.

This way you will have peace of mind and tit for tats to your miscreant wife as described by you.

1. Since the proeprty is on your father's name, you may ask your father to file an eviction petition to evict her from his property, but you should not live in that house.

2. You have been thinking about the years of legal case and that way its been years that you have not taken any legal action to throw her out of the house legally.

If you do not initiate an legal action to eject her out of the house then you will repent very mush at a later stage for not effectively handling her when the time was ripe.

Hence you act swiftly at least now.

3. For false affidvit, it becomes your duty to prove it false after which you can plan to file a perjury case.

4. Your father can very well lodge a criminal complaint against her for her tortures and harassment besides he can file a defamation case also.

5. The limitation for filing defamation case is two years and not three years.

1. Filing of suit for eviction is the only remedy.

2. She has no share in the properties of her in-laws. If she has taken the possession of the property then filing of a suit for eviction is the remedy in the hands of your father.

3. Unless it is proved that the affidavit given by her is false she cannot be made to face perjury. It is for you to prove the falsity of her affidavit.

4. File a complaint against  her and get the FIR registered under Section 506 IPC for criminal intimidation if you have been threatened with death.

5. Unless the allegations made by her are proved as false you do not have a cause of action to file a defamation complaint or even a suit for damages.

4. 499/506 आदि नही बनता हाँ यदि आप लोग उस मुक़दमे में जीत जाते हैं तब आप मान हानि का मुकदमा डाल सकते है, आपके पिता जी सिविल सूट डाल सकते है और निषेधाज्ञा की डिक्री कोर्ट से उसके खिलाफ ले सकते है जिससे वो आपके या आपके पापा के दफ्तर में न जा सके यदि उसने किसी तरह का कोई पब्लिकेशन किया है जो मानहानि करता हो तो मानहानि का केस दायर किया जा सकता है.

5. जी तीन सालो के अन्दर (जब आप के ऊपर चलने वाले केस ख़तम हो जाए और आप या आपके पापा बरी हो जाए तब) आप या आपके पापा मानहानि का मुकदमा डाल सकता है और कम्पनसेसन मांग सकते है दांडिक कार्यवाही भी कर सकते हैं.

Your father can file an eviction suit against daughter in law (Your Wife) , he should also file a complaint in your nearest police station that he have threats from daughter in law this will help you in case they retaliate on your filing of Evicition suit.. 

If a house exclusively belongs to a father-in-law and his son is living separately, the daughter-in-law has no right to live in the house. The property cannot be claimed to be a shared household.

If this is proved a false case then you may file a criminal defamation case against them u/s 499/500 of IPC.

No you don't require the ownership of that house to evict her. It is a fact that the house is the joint family property and she is not the at all a shareholder of the same. You don't require ownership documents

If the property was on your late grandmother's name and upon her intestate death, the property shall devolve equally on all her legal heirs.

The legal heirs shall comprise her children both male and female.

The partition between your father and his brothers is not legally valid.

They cannot claim title to the property or their respective share in the property based on this partition which excluded the female children of your late grandmother.

Thus your father's female siblings are entitled to a share out of their mother's property, which cannot be denied and if one of the sisters is living in that house, your father cannot evict her from that proeprty until the partition suit disposed and the share allotted to your father by court decision.

While posting the original question, you have not given the details what you have furnished now, hence ther may be incorrect opinion to your problem.

Mutual partition is invalid and grand father consent has no value. Daughters have to execute release deed in favor of brothers to make them sole owner.

Your local lawyers are wrongly advising you. Non Mutation dose not make any difference. Your father have inherited the property and is actual owner and can evict her.

Law is clear - daughter-in-law has no right in a property which exclusively belongs to her parents-in-law and such a property cannot be treated as a shared accommodation.

- As per law, a daughter in law is not having any right over the property of her in laws whether ancestral or self acquired .

- Hence, it is wrong to say that the daughter in law cannot be evicted from the property of in-laws or even the said property is in the name of grandfather.
