• Website to allow users to place order for hard liquor

I want to create an online portal from where customer can place an order for hard liquor.

1. We will only be displaying menu and taking order from web portal, We will pass on order to liquor shop.
2. Order will be delivered by shops which are nearby to customer.
3. Payment and Delivery will be handled by shop only.

We will only be passing orders to authorized liquor shops which have permits.

Can I make such website are there any legal obligations ?

Delivery of liquor is not allowed. 

So practically it won't work.

Once govt allow doorstep delivery of the liquor than only its possible.

Actually as per the bombay prohibition Act and rules it's illegal. But govt only due to pandemic come across a temporary order selling it online. Only through special permission of excise the same can be done

- Selling liquor online is illegal in India , due to states separate rules and regulation .

- Under Section 139 of Maharashtra prohibition Act , the Maharashtra government has allowed the home delivery of liquor.

- Similarly , Delhi has also allowed, but there are many states in India , where it is banned . 

- Since, after creating online portal , you will receive the order from the customer , hence legally you will be delivered the liquor , and not the shop .

As a media man you can do this. No legal bar.  But you can not collect any money from customer. You can collect commission from the liquor shop.

1. Selling hard liquor is not permissible without allotment of license.  Online sale is equally prohibited. 

2. Through F.L.OFF Shop also its equally not allowed. 

3. Since advertisement of such hard drinks through amy medium of publicity ys not permissible I regret you can't do such business without getting yourself landed at the wrong hands of law.

Home delivery is not yet facilitated and permitted by govt. Until not specific permission from govt. Home delivery not permitted.

Home delivery license is varreid state to state. Due to corona,  some states permitted home delivery temporarily.

You can just advertise but can't sell online or deliver online after pandemic. In pandemic too you require excise permission

In my opinion this type of business may not be a legal business.

 You can order wine, spirits and beer online from retailers like Liquorama and have it shipped directly to your door. There are some states where purchasing alcohol online is restricted however.

According to Bombay Prohibition Act, 1949, purchasing, possessing or using any liquor or alcohol without a valid permit is prohibited.

Anything concerned with the liquor sale whether online or offline, in the manner you may describe may not be legal.

You should be aware of the various provisions of Bombay Prohibition Act, 1949 in this regard before venturing into any adventurous activities for any purpose.

Before starting such a website learn about the liquor policy of the state government. Getting a license for selling hard liquor is important to full fill your idea. So best way is approach the government because some of the agencies along with government already think about to the same and done some work for that to avoid overcrowding at the liquor outlets across the state when they resume operations after being shut for over two months due to the COVID-19 induced lockdown.

1. Events /History described by you implies that you are going to act as an "Conduit Person /Representative" after obtaining authorization of the various Dealers /Traders dealing in alcohol. This also means that you are NOT delivering or selling /dealing in alcohol.

2. By virtue of above, you do not require any type of alcohol selling license etc....

you are not directly selling hard liquor

you only connect the buyers to the liquor vendors

so in my view the license for liquor sale wont be needed

however in order to allay any apprehension, it is best to seek a clarification from the department itself

No as per alcohol laws in India you can't sell liquor online or even you cant home to deliver it till the law is reformed only you can sell liquor in shops only but for that also you have to take a license from various government agencies.
