Case :If a girl alreday converted from religion A (hindu) to religion B (Christian) and already has a certificate of conversion recieved from religious B , will she still be able to convert to religion C ( muslim )

Inputs : 
Mother deceased who had converted from religion A to religion B before death 

Previous conversion took place without mutual concnt of the girl has on of the family member involved in inter religion marriage which came in clause of changing religion of whole family

Now Girl alone want to convert to religion C and get married to the person or same religion

1-No restrictions for conversation until Act and intentions of parties are illegal and for the purposes of defeying the provisions of law.

2-Any act of conversion which ultra vires the provisions of law doesn't approves and confirms legalization of entire state of performance of parties. 

3-Any act of conversion should not be with motive to deceit the provisions of law of property and marriage. 

Indian Constitution does allows conversion from one religion to another with good intentions to follow the subsequent religious beliefs and principles piously and strictly.

Any citizen of India is at her/his liberty to profess any religion of hi/her choice and can convert to any religion at any time, it is their right hence law cannot interfere in this.

If the girl wants to convert to Islam from Christianity, it is her decision, no law can forbid her from doing so.

She can proceed with her intention to convert to the religion of her choice and also go ahead with the proposed marriage.

 - Under Article 18. Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his own choice and freedom, either individually or in community with others and in public or private, to manifest his religion or belief in worship, observance, practice and teaching.

- However, the Supreme Court in the matter of Sarla Mudgal v Union of India, has held , that conversion to Islam only for the sake of solemnizing a second marriage without dissolution of the first valid Hindu marriage will not invalidate the first marriage. In fact, the second marriage will be invalid.

- Hence, if someone convert to Islam , only for getting marriage  , then that marriage will be not considered a legal marriage. 

- Yes , that girl is free to convert to C religion legally ,and further she can also marriage with the same religion , with a condition that she is converting the C religion for faith , and not only for marriage.

The person is required to amend all the documents i.e. aadhar, pan ,passport ,bank passbooks , degree SSLC certificate ,birth certificate on the choice of her name. The certificate of previous conversion is not required. The marriage can also be held as per the wish of the individual.

She has to have a conversion certificate issued by a maulvi.

She isba Christian and in her school certificate or aadhar it must've  been mentioned. That is sufficient. All other documents which she has is sufficient. Previous certificate will not be an issue.

Dear Client

  • This is to inform you that, you can convert into any religion you wish to follow, as an Indian citizen you have the right to practise any religion you want according to Article 25 of the Indian Constitution. So therefore, for it is completely your wish whether you want to convert or not.

  • In general, Islam allows for marriage between a man and woman as "believers". Culturally, it is accepted that marriage between a follower of islam (muslim) and a Christian or Jew does not require conversion.

  • That, the religious conversion of girls "without their faith and belief in Islam" and "solely for the purpose of marriage" to Muslim boys is not considered valid in the eyes of the law.

Therefore, you can get married to the person of different religion without converting yourself unless you wish to convert and follow the belief of that religion other wise you can get married under the Special Marriage Act and continue to follow your current religion.

It is advisable to not to convert your religion and to get yourself married under Special Marriage Act as that is much easier. Besides, conversion only for the purpose of marriage is illegal per se. 

As far as documents are concerned, then - 

You need to get an affidavit prepared of yourself that you wish to change your religion and then have to go to Mosque to get the needful done. Then you will have to get that published in newspaper (Hindi as well as English) and then with that publication you have to make rounds to every government office to get your religion being changed on every documents of your own. 

This entire process will take minimum of 01 years and maximum could be anything.
