• Where should we get our marriage registered?

We got married in December 2017. Both our permanent address is of Delhi, but we are currently staying in Gurgaon and the wedding also happened in Gurgaon itself. Where should we get it registered - Delhi or Gurgaon? Also, I read somewhere there will be some fine for getting it registered late, is it true?

You should register marriage in Gurgaon as marriage was solemnised in Gurgaon and you are residing in Gurgaon at present

Your marriage can be registered at either of the two places i.e. Delhi or Gurgaon. Marriage can be registered at place of solemnization of marriage for permanent address of either of the parties or the place of permanent residence of either of the parties.

There is no fine for late registration of marriage as yet.

Yes, absolutely, you can get your marriage registered after 3 years of customary marriage, but for that, a legal procedure is to be completed by a legal consultant,

Finding a family law lawyer is preferable if one needs to get a certificate by a court marriage. Marriage certificate may be obtained for an already solemnized marriage or through court marriage, which is governed under the Special Marriage Act, 1954.

These factors can be explained to you by a legal assistant, for that you just need to dial +91–[deleted].

There are certain eligibility criteria and documents required for obtaining a marriage certificate. They are as follows :

  • The male or female shouldn’t be married to someone else at the time of the court marriage.
  • Consent should be free and not forced for the marriage.
  • The age of the male for marriage must be more than 21 years and the female should have completed 18 years of age.
  • The parties should not fall under the purview of degrees of prohibited relationship mentioned in schedule I of Special Marriage Act,1954. For example, a father cannot marry his daughter, a mother cannot marry her son, a brother cannot marry his own sister, etc. However, if the parties’ custom allows it, it can be valid once they have proven that it is their custom. For this reason, one will need to hire a lawyer to be safe.

The document required are:-

  • Application form duly filled and signed by the parties.
  • ID Proof of both the parties. ( For example Aadhar Card)
  • Residence Proof. (For example electricity bill or Passport)
  • Documentary evidence of the date of birth of the bride and groom. (For example passport)
  • Marriage Ceremony Photos.
  • One photo of the family.
  • Two witnesses each from both the parties. (Two should be blood relatives, one to each party)
  • Passport size photos of all the witnesses.
  • Photo ID of witnesses.(to prove that they really are blood relatives)
  • Receipt of marriage hall.
  • Seven copies of joint photographs of the couple.
  • Affidavits from bride and groom.
  • A group photograph of all the people present with the couple. i.e. the witnesses and other things which only a legal consultant will be able to tell you.

To get the application for obtaining a marriage certificate and for other formalities, a lawyer might be needed. So, hire a lawyer as soon as possible if you are looking to get a marriage certificate.

The procedure for getting a marriage certificate is as follows:-

  • The application in the prescribed form with the required documents is to be sent in the court of Marriage Officer. (Addl. District Magistrate, Collectorate)
  • The Court will get all the declarations of the parties verified and shall register the marriage in the presence of four witnesses, two of which shall be blood relatives of the couple.
  • After the registration of marriage is done duly keeping in mind all rules and regulations, the marriage registration certificate is issued.

- As per Hindu Marriage Act , marriage can be registered in the office of the Registrar of Marriage within the jurisdiction under which the marriage taken place or in the office of Marriage Officer in whose jurisdiction the bride or bridegroom resides.
