• Impersonation/ID Theft issue using a recently created Aadhaar card with my exact name

It recently came to my notice that some unidentified people are trying to do a land registration fraud in local sub-registrar office using an Aadhaar card (created recently using my exact legal name and also referring to my father's exact legal name in the address --but with a different date of birth/postal address), duplicate copy of sale deed. Could you please advise what steps I need to take to prevent this fraud? Thank you in advance.

2) Section 66C provides for punishment for Identity theft as: Whoever, fraudulently or dishonestly make use of the electronic signature, password or any other unique identification feature of any other person, shall be punished with imprisonment of either description for a term which may extend to three years

You can also lock the adhar card in uidai app. You can file FIR for cheating and forgery. You can file a shot for cancellation of suit in court

You can file a police complaint before the police station against the fraud and the conspiracy and also can give an application mentioning survey number to the sub-registrar office to not to register any property without due verification.

- Since, an ADHAR Card having biometric information with other details , hence it is very confidential document.

- But it is very difficult to misuse others Adhar numbers and to get the duplicate copy of others.

- The 'Aadhaar Authentication History' option on the UIDAI website allows you to check where your Aadhaar number was used for authentication.

Further , UIDAI also provides a mechanism to lock the biometric information and prevent any misuse.

- You should check the same from the website , that somebody has misused your adhar card .

- You can also register a complaint with the authority if you find some suspicious activity involving your detail.

3. If yes, then immedialey lodge a police complaint enlosing the copies of the said evidence and mark a copy of the said letter to the local sub-registrar.

You can make complaints online on AADHAAR portal. Plus give written application to revenue department of state that all registered office not to make any deed registered for your land.

Inform the duplicate aadhar card no. to police for investigation. And also to concerned registry office with a request not to registered any sale deed of your land by that fake card. Give your original aadhar card no. With a photocopy alongwith your land details. 

You can also make a paper publication about the fraudulent attempt of sale of your land giving your contact details.

1. It is not clear whether the sale deed is registered or not. in false name of yours.

2. if yes then immediately lodge a complaint of forgery and impersonation against the person  who has made the forgery on which the police can register the FIR and arrest the culprit as well.

3. Then file a suit for setting aside the forged deed.

You need to lodge FIR against those unknown persons for suspecting fraud on your name. 

And also send a intimation letter to sub registrar office to provide you the next date for registration of property so that those people can be traced.

But there can be another person with same name and father name living on the address mentioned in his Adhaar card.

First of all immediately write an application in the name of the Registrar Saheb mentioning all the facts  and requesting not to entertain such sale deed, get it received personally in his office, benefit of this will be that he will not entertain any sale deed concerning your property , paste a copy of the same on the notice board of the Registrar Office and take  a photo from mobile and after doing this exercise write same application in the name of the concern SHO of the Thana in which the property lies for forgery and cheating, then see what happen.

Immediately you lock your Aadhar ID on portal.

Lodge complaint with police bringing to their notice of above said incident by sharing the IP address and login details of fraudster you have, with all concerned.

Share the details of Fraudster which you got from your source / portal with police.

Do not forget to follow up with the police after 21 days.

If they do not respond, file an RTI application seeking action taken details on your complaint.  

Have record of everything you do.

You may have to first issue a legal notice to the concerned registrar about this fraudulent activity  giving the entire details of such activities and request him to not to entertain ny such transaction from anyone until and unless the genuineness is verified and confirmed.

The registrar may not accede to your request hence immediately after that you may have to file an injunction suit seeking to direct the registrar to not to entertain any transaction with regard to the schedule of property as mentioned therein till the disposal of suit.

This will ensure that no such fraudulent activity takes place.

1. YOU WILL HAVE TO WRITE TO THE SUB-REGISTRAR TO DESIST FROM REGISTERING ANY DOCUMENT PURPORTEDLY PRESENTED FOR REGISTRATION BY YOU, BY THE MISCREANTS

2. FIRST YOU NEED A DOCUMENT WHICH MENTIONS YOUR NAME, YOUR FATHER'S NAME, YOUR RELATIONSHIP WITH FATHER AND YOUR DOB - THAT DOCUMENT IS A BIRTH CERTIFICATE

3. THEN YOU NEED YOUR DOCUMENTS LIKE AADHAR AND PAN WHICH SHOW YOUR NAME, FATHER NAME AND ACTUAL DOB

1. You shall have to prove that there is an atempt to defraud you by registering your property with the help of Aadhar Card having your and your father's name.

 

2. Having  name  and father's name same to that of yours and your father's is not an offence. So, you shall have to have evidence that some one having different name is using Aadhar Card having your name to register a deed of conveyance in connection with your property.

 

3. Being equiped  with trhe above evidence, you can lodge a police complaint under copy to the D.C./S.P. and also the Registrar.

 

4. Gist of the said letter can also be published in 2 local Newspapers, one being in vernacular, notifying the public in general about the said attempt  to fraudulently sell your said property.
