• Single certificate for marriage

Hello where can I get a single certificate for my fiance from the USA, he is a foreigner, can you please help me? How much do you charge to provide it? I need it in a day.

I also want to ask what other documents do I need to bring? NOC from Embassy is it a must? thank you. I read that it is no longer compulsory so can you help me with this?

He will be coming here tomorrow, can we just go to the registration office, and sign the documents for Special marriage act? Or does he need to stay 30 days here before to apply? I am a resident of India, so will it be fine, if I show that one party is staying here for more than 30 days.
How long does it take for us to get the date of the wedding ?

Here are the list of Documents we have so far, please let me know if there is anything else I need.

Dear Madam,

The Special Marriage Act of 1954 dictates a 30-day requirement for residency in India, which means that at least one party of the wedding has to be living in India for at least 30 days before applying to get married. You'll have to prove it from a certificate issued by the local police station.

An expat or foreign national marrying an Indian citizen will need some additional paperwork, but doesn’t need to become a citizen of India in order to get married.

B) Special Marriage Act

Both parties are required to be present after the submission of documents for issuance of public notice inviting objections.

One copy of the notice is pasted on the notice board of the office and a copy of the notice and is sent by registered post to both parties as per the given address.

Registration is done 30 days after the date of notice after deciding any objection that may have been received during that period by the SDM.

Both parties along with three witnesses are required to be present on the date of registration.

Important documents to carry along

 

  1. Application form duly signed by both husband and wife.
  2. Documentary evidence of the date of birth of parties (Matriculation Certificate / Passport / Birth Certificate) minimum age of both parties is 21 years at the time of registration under the Special Marriage Act.
  3. Ration card of husband or wife whose area SDM has been approached for the certificate.
  4. In the case of Special Marriage Act, documentary evidence regarding stay in Delhi of the parties for more than 30 days (ration card or report from the concerned SHO).
  5. Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality.
  6. Two passport size photographs of both the parties and one marriage photograph.
  7. Marriage invitation card, if available.
  8. If marriage was solemnized in a religious place, a certificate from the priest is required who solemnized the marriage.
  9. Rs. 100/- in case of Hindu Marriage Act and Rs.150/- in case of Special Marriage Act to be deposited with the cashier of district and the receipt should be attached with the application form.
  10. Affirmation that the parties are not related to each other within the prohibited degree of relationship as per Hindu Marriage Act or Special Marriage Act as the case may be.
  11. Attested copy of divorce decree/order in case of a divorcee and death certificate of spouse in case of widow/widower.
  12. In case one of the parties belong to other than Hindu, Buddhist, Jain and Sikh religions, a conversion certificate from the priest who solemnized the marriage(in the case of Hindu Marriage Act).

A Certificate of bachelorhood/single-status/eligibility to get married can be issued by a competent court having jurisdiction of the area of the residential address of the applicant. It cannot  be procured in India for a person who is a citizen of The United States of America.

NOC would be required . Its a requirement that if American citizen wishes to wed in a civil marriage ceremony he may be required to present to the marriage officer a ‘no objection letter’ from the US Embassy or Consulate, as well as proof of termination of any previous marriage if any. 

Date of wedding would be given after all the documents have been verified and depending upon the workload of the authority. There exists a 30-day notice requirement to be given in India if one partner is permanently and the other partner is temporarily residing in India. As one partner is residing in the foreign country, the ‘Marriage Notice’ form has to be filled by the partner in India and also the partner in the foreign country, which has to be resubmitted to the Registration office.

A valid visa of more than thirty days for the foreign national and adequate documentary evidence of 30-day residence in India would also be required other than the documents you already have.

Your fiancée has to 

  • Visit the nearest American Consulate or Embassy in the country where he is at present .  For a full list of addresses, phone numbers and websites for each consulate, visit the embassy section of the website of the U.S. Department of State at usembassy.gov.
  • Schedule an appointment online at the appropriate U.S. embassy. All Citizen Services must be scheduled by appointment, walk-ins are not accepted at the door.
  • Attend your appointment and bring your passport. At the appointment the U.S. consular officer will ask you for your passport and for the names of your parents (full names as they appear on your birth certificate) and your own. They will write the affidavit and have you sign it. It is valid once the consul signs and stamps it.
  • The fee for the certificate is $30 U.S. dollars and can be paid in USD in the form of cash, credit card or traveler's checks.

Solemnise your marriage with your fiancé under the Special Marriage ActUnder the Special Marriage Act of 1954, it is clearly stated that at least one of the potential couple must have stayed in India for a period of 30days before applying to get married. Thus, since you have stayed here for more than 30 days, not necessary to wait for 30 days before approaching the Registrar. The whole process of getting your marriage solemnised from the day of moving the notice of intended marriage could take about a month.

In India to register marriage no certificate confirming your status as ' spinster' is not required at all.

if you are previously married the  decree of dissolution of marriage is necessary but if you are unmarried t the time of marriage then no manner of certification is essential from any corner at all.

The documents you have is enough to get the marriage under Special Marriage Act.

Dear Cleint,

A Certificate of bachelorhood/single-status/eligibility to get married can be issued by a competent court having jurisdiction of the area of the residential address of the applicant. This can be in the form of a declaratory order for which a suit has to be filed before the appropriate court for the specific purpose which is required to be counter-attested by the Home Department of the State concerned. Thereafter, it is to be attested/apostilled by the Attestation Section of the Consular, Passport & Visa (CPV) Division of the Ministry of External Affairs, New Delhi.

Lengthy process, not in a day. And in India no such certificate requires, just declaration in form.

Mere notorised affidavit will be fine.

One of the parties to the marriage is residing for a period of not less than 30 days immediately is enough. One month notice period.

3 passport size photos, 3 witness. Address proof.

For That you hve to apply for certificate in Indian Embassy. 

Documents required for applying are

  • affidavit stating the affiant is single with more requisite details of address, identity and witnesses.
  • Address proof, like Bank Passbook, rental agreement, voter ID, Aadhar card etc..
  • Passport or visa
  • Birth proof, like birth certificate, NABC, school certificate.
  •  Parents’ proof, their voter ID, Aadhaar card

 

 

The notice of MARRAige shall be served to marriage officer before 30 days of marriage and it is mandatory to serve the notice of marriage 30 days prior to marriage.

And as per special Marriage act the single certificate is not required for marrying.

For single certificate to your fiance, you cannot get a certificate in India, he has to obtain the same from that country only.
