1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

You can file a complaint against the builder with the police under section 406 and 420 of the Indian penal code for the offence of criminal breach of trust and cheating.

Simultaneously, complaint needs to be given to the economic offences wing against the builder for the fraud committed by him against the general public.

In order to get the refund along with interest and compensation, complaint can be filed in either RERA, NCLT or Consumer Court. I would advice NCLT as that is the fastest way to get your money back.

Also, try to take recent pictures of the project you have invested in to prove the fraud played on the public by the builder.

A legal notice should be send to then warning them if dire consequences in case they do not respond.

If they dont then an fir must be filed against them under relevant sections of the Indian penal code.

Also a case must be filed against them in the rera tribunal for deficiency in services.

You state that you have sent a letter by R/D but no reply has been received. In such a case you can move consumer forum against the developer for deficiency in service and ask for refund of money with interest and also claim compensation for the harassment you have gone through.
