Police would issue you notice to record statement
2) deny allegations made in FIR
3) contact a local lawyer and apply for bail
Sir in my view she has filed 498a case on you of so is the case file a quashing petition before the high court and seek anticipatory bail to avoid arrest if FIR is filed.
How can section 490 be invoked
Kindly share the copy of the FIR for a concrete and more appropriate advise
Regards
A 498a case has been filed against you. Approach the high court so that it may direct the police to investigate the matter fairly and give you an arrest stay.
After that the case would be tried in a court.
Regards
Dear Sir,
Section 490 is in respect of : Breach of contract of service during voyage or journey. Section 491: Breach of contract to attend on and supply wants of helpless person.
It seems you might have misquoted the section instead of 498A. You may substantiate before the police that she is making false allegations you have every right to challenge such FIR in High Court and get it quashed.
IPC 490 is repealed.
Section No: 490 Chapter No: 19 Breach of contract of service during voyage or journey. (Indian Penal Code 1860 (ipc))
Is it 498A or section 490?
By mistake you might have mentioned it as 490.
If the police have registered FIR on her complaint then you may first obtain AB and then challenge her false allegations in the trial court.
