• Passport and Aadhaar Card

My daughter is a divorcee with a daughter[ aged 3.5 yrs]
As a grandfather, I am interested in knowing if we can apply for grand daughter's passport with 'Single Parent' category and mention her name as ...her name.then..her mother's name [as on mother's passport]..then....her mother's last name [as on mother's passport]? As per amendment in passport laws I feel that This will be accepted. Your advice?

This is my response to you:

1. Yes your daughter can do that as per the notification and as per the Orders of the Delhi High Court;

2. And also the same for aadhar card;

3. But make sure you carry the notification relating to passport along so that the officers/authority do not dispute the same;

4. The Court has insisted that mother's name is sufficient and the same will be acceptable;

5. If any more confusion then consult a local lawyer.

Procedure has become easier for single parents to apply for passports for their children. The online passport application form now requires the applicant to provide the name of father or mother or legal guardian, i.e., only one parent and not both. This would enable single parents to apply for passports for their children and to also issue passports where the name of either the father or the mother is not required to be printed at the request of the applicant

the passport application form no longer require the applicant to provide the name of her/his spouse in case of separated or divorced persons. Such applicants for passports would also not be required to provide even the divorce decree.

It is not mandatory to mention father’s name in case the mother is a divorcee.

Yes Sir after the judgement of the Delhi high court the passport can be made in single name of mother and further the policy is also changed for the single parents so the application can be given for passport. Further for name change an affidavit has to be made for adding mother surname, then after name change her adhaar and passport can be made accordingly.

For name change mother has to do an affidavit for daughter and same need to be published in two newspaper.

1) Yes, You grand daughter can apply with her mother's name for passport. and the form comes like that only and same you can make Aadhaar Card by her mother's name as middle name.

Hi

1) You can apply for your grand daughter's passport with single parent category by submitting an affidavit titled ANNEXURE ‘C’ which reads as follows:

"SPECIMEN AFFIDAVIT TO BE SUBMITTED WITH THE APPLICATION OF A PASSPORT TO A MINOR CHILD BY A SINGLE PARENT OF THE CHILD BORN OUT OF WED-LOCK"

2) You may refer to http://pib.nic.in/newsite/PrintRelease.aspx?relid=137190 for downloading the affidavit.

3) With reference to Aadhar, for children below the age of 5 years, it is known as "Baal Aadhaar" and is blue in colour. and the Mother's Aadhar card along with the child's birth certificate is required to enrol the child for Aadhaar. Biometric will not be collected from kids up to the age of five. The kid's Aadhaar will be linked to her/his Mother's aadhar.

4) Also in aadhar filing form , Filling Father / Mother / Husband / Wife / Guardian field is not mandatory for residents above the age of 5 years in case the adult is not in a position or does not want to disclose. Then select checkbox “Not Given” in “Relationship to Resident”.

And Aadhar card and passport can be issued to child of single parent.

Actually in your granddaughter case she is not a single parent child as her father is alive and mother is divorced so in this case both are present.

The father is the natural guardian of the child Till the age of 5 years mother can be the gardian.

Now under the amended passport rules the name of only single parent is required to be mentioned in the passport application form, but it is observed that many RPOs continue to demand the name of both parents in violation of the rules. So eventually a writ petition may have to be filed in the High Court.

Yes as per Passport Act 1967 r/w Passport Rules 1980 has been amended after the case of Priyanka Gupta which is a famous case and now single parent can write only his/her name giving reason. The same is with Aadhar card so please go ahead.

How to Change a Child’s Name/Surname After Divorce

The legal surname of the child is the surname nominated by the registering parent or parents at the time of the child’s birth. This is often the surname of the child’s father.

In the event the relationship between the parents subsequently breaks down, then one of the parents of the child may wish to change the child’s surname. This usually happens if the mother has adopted the father’s surname at the time of marriage, and subsequently wishes to revert to her maiden name after separation. So that the child does not have a different surname to the mother in that instance, the mother might then seek to change the child’s surname to her own maiden name or hyphenate her maiden name with the father’s name.

In other situations, the mother of the child may remarry and adopt her new husband’s surname and seek that the child from her first marriage also adopt her new husband’s surname. This is particularly the case if the father of the child is estranged from the child and the child views her mother’s second husband as his or her paternal figure.

How to change a child’s name if both parents consent

In the event that the child’s parents are listed on the child’s birth certificate and both consent to a change of name, then the parents may jointly register an application to register a change of name at the Office of Births, Deaths and Marriages.

In the event one parent wishes to change a child’s name, and this is opposed by the other parent, then it is advisable the parties participate in mediation to try to resolve the matter. Depending upon the age of the child, the parties may consider that the child also participates in the mediation so they may take into account any views expressed by the child, especially if the child is a teenager.

Single women can now apply for the passport of children without the consent of father.

The first reform came when the ministry of external affairs ruled that it was not necessary to provide the name of both parents in the case of a child’s passport.

The name of the father, the mother or the legal guardian was sufficient it said. This has enabled single parents to apply for passports for their children.

Besides, the passport application form does not require the applicant to provide the name of the spouse in case of separated or divorced persons.

passport office continues to receive applications from women seeking name change, without any supporting documents apart from self-declaration. Passports are issued in such cases.
