• Police harassment

Me and my female friend (we both are 24 years old) were wondering around 8 pm and two police came and treated us badly. they asked my id, asked how much money I have, threatened to detain my bike, telling to our parents and threatened to call police van and bring us to police station, hit me, and used abusive language to me and her. We got scared and complied with them so they took benefit. I forgot to ask their name because I was afraid this was first time.I want to know what sould be proper response of a citizen in situations like that and among the details above what are legal and illegal things they did.

1. No police man can take unto their hands more so when no crime was committed.

2. there is no law prohibiting a couple in wandering the streets if the same is not causing any nuisance or disturbance to the public.

3. Since none was committed by you they committed crime for which they can brought to books.

4. So lodge a complaint to the police station where this incident happened. If you did not know their names then also there is no problem as they can find out their identity form the duty roaster.

5. After lodging complaint with the local police bring this to the notice of higher officials also.

1) If you don't remember their names and what questions they had asked you exactly. Anyhow you can't lodge complaints against them because they may tell you that they're doing their duty. So don't go unnecessary in deep for any further investigation or still you want to proceed further you can make complaints in police commissioner office in writing.

Firstly, we are living in the country where our fundamental rights are the strongest foundation of our democracy and constitution.

Secondly, if you have been indulge in any sexual activity at a public place or doing something illegal thing like misbehaving, forcing someone to do which they are not blind to do etc. only then can be taken into custody otherwise not.

Thirdly, you can make a complaint to the Mazistrate to take action against them under section 200 of CrPC.

This is my response to you:

1. You can file a complaint against the police under the following captions:

a. Excessive use and abuse of authority;

b. Extortion;

c. Grievous hurt or simple hurt;

d. Arrest or detention without due process of law;

2. You can file an FIR against the police officers if you know which chowki they work at;

3. Take a lawyer with you to file an FIR against them as police have to register FIR under section 154 of CRPC;

4. As per the Indian Police Act, 1861 you can file FIR under sections 29 and 34 of the Act;

5. Take legal steps otherwise those culprits will continue their ill deeds.

You should ask for their identity card .

However police personnel has some power to prevent offences which they misuse and cause trouble to innocent people . You can file a complaint against the said policemen by stating the date and time and place of occurrence.

3. You and your friend are free to file a FIR against cops for criminal intimidation under Section 506 IPC and illegal restraint under Section 341 IPC.

They could not have taken any money from you or could have treated you this way, that is the first thing they should have not done.

In such situation, you must take note of the name of the officer from his name plate and immediately approach the police. If police refuses to take action the approach the human right Commission.

If you can identify the policemen who threatened and indulged in such illegal acts, you can lodge a criminal complaint against the said police for the grievances caused to you with the jurisdictional police station or with the higher police officer

You can narrate the entire act of humiliations and insulting behavior by the police in your complaint.

If there is no action from police against the mischievous policemen, you may approach the judicial magistrate court with a petition under section 156(3) cr.p.c. seeking it s direction to the concerned police to initiate proper legal action for such dastardly act.
