• Regarding permission to visit abroad work place

Hello All,
I veerpartap Singh, married FEB, 2011 and I left from India for abroad April 2013 having successfull married life for that past  time period (Feb 2011- March 2013) for the betterment of future and life. I also tried to make visa application for my wife but my in laws refused me to give neccessary docs failed which I only have to left. In April 2013 I left and May 2013 her parents misguide her to register false cases against my parents and me. U/S 354 case was registered against my father and they failed to prove the allegations and their application was rejected by the session court. Also the appeal to the court as dismissed. U/s 498A, 406 case was registered in March 2015 and I was PO in that case due to which I was arrested on November 2017 at delhi airport when I came back. Its been over 3 months I  am not able to visit back to my work place in Abroad. which is important for my future plans. 

My question is how can I convience Honorable court to give me the permission to vist my work place and I would present in front of Court on every Procedding date of Court.  My father is retired 68 yrs old man and my mother is home maker and hardly able to walk and due to knee problem.

1. You may take the ground that the complaint is vexatious and has just been filed to harass.

2. She has the tendency of filing false and frivolous complaint (show them the case of 354)

3. that not going to foreign land will hamper your future

4. On the above ground assure the court that you will participate in the trial

You can make application for exemption from personal appearance till further orders seek court permission to travel abroad for work purposes

Dear Concerned,

If you passport has been confiscated you will not be able to travel overseas for your job. In your case as you were declared proclaimed offender as soon as you file an application for release of passport your application will be objected , leading to dismissal of application. Technically you will not be able to travel until you have your passport.

In case you have your passport you can leave the country through other means as well. However it is better to settle the case with your wife and get the FIR quashed from the High Court to have a peaceful life.

File an application in the Court and pray for lifting of the travel ban imposed on you.

Give an undertaking on an affidavit that you'll make yourself available before the Court on all occasions when the matter is listed for trial.

If you have bail you may apply for the permission to travel and assure the HIGH COURT that when required you will be available in the court.

The case will take its own time after the FR or Charge sheet by the police but in the meantime you will be able to travel and work overseas.

You cannot travel abroad for the purpose of employment when there is a criminal case pending against you.

The court will not be interested whether you work or dont.

You somehow have to manage till the disposal of the false criminal complaint against you

You can file the application before the magistrate for permission to travel abroad and convince him that you will be available for investigation if called for. You can state that you are providing the address of your stay at abroad and telephone numbers of contact if required.
