• Inclusion of surname in educational certificates

Dear sir, is it necessary to include surname in educational certificates retrospectively, as I have included surname legally through affidavit and gazette publication, I need to apply higher studies in foreign universities, will there be any problem? I am from karnataka

No there will not be any problem.

Get an affidavit that name of both the person is same.

For changing name in educational certificates you will have to obtain an order from the court.

190016/187-Estt. dated 12th March, 1987 from Department of Personnel and Training.

The Ministry of Home Affairs O.M.No. 67/274/48/Estts. dated 3rd November, 1948 as amended vide O.M. No. 87/52Estt. dated 24th March, 1952 lays down the procedure for change of name by Government employees. The Govt. recently had the occasion to review these instructions in the light of experience in certain cases. It was found that the instructions are in complete in so far as they do not cover certain situations. It has, therefore, been decided to adopt the following procedure in suppression of all previous orders on the subject.

I. All cases of addition/deletion or change in name/surname:-

i. A Govt. employee wishing to adopt a new name or to effect any notifications in his/her existing name may do so, formally by a deed changing his/her name. The sample deed form is enclosed.

ii. The execution of the deed should be followed by publication of the change in a prominent local newspaper as well as in the Gazette of India at the Govt employee’s own expense.

II. Addition/Change in surname only, on account of marriage, remarriage of a female Govt. employees.

i. If the Govt. employee desires a change, she should give a formal intimation to her appointing authority of her marriage and request for a change in her surname.

ii. Particulars of the husband may be given for making necessary entries in the Service Book.

III. Deletion of surname or reversion to maiden name on divorce/separation or death of the husband of female Govt. employee, change may be permitted if a female Govt. employee gives:-

i. An intimations to the appointing authority regarding change in marital status; and

ii. A formal request for reversion to her maiden name.

NOTE: - There is no prescribed form for items II and III.

Indian gazette notification may not be recognized in other countries as they may not be aware of the law of the land.

Make changes from now on to reflect your surname.

Check the name in passport. If your surname is added in passport then there is no problem in further studies abroad. There would be no problem in applying for higher studies in foreign universities. You can use the gazette publication for your future references.

1. You do not have to incorporate surname in the educational certificates which were issued prior to the adoption of the surname, neither will it be allowed. A prospective adoption of surname does not give you the right to incorporate the surname in the educational certificates retrospectively.

2. However, incorporate your surname in the documents of identity i.e adhaar, PAN Card and Driving License.

There will be no problem, since you have already added your surname after your name through a valid legal procedure.

Henceforth, you can use your full name in all the application forms, etc.

You cannot add or cahnge the name in the educational certificates even though you got your name changed through gazette publication.

You can proceed with the new name for all future events by keeping a copy of this gazette publication with the educational certificates which bear the old name

will my Indian Gazette notification is valid in other countries? If any discrepancies in the name in future, only Gazette notification is sufficient?

The Gazette publication is published by government for all practical purposes to make it a valid legal document, hence, if the other educational certificates are valid,, then this publication by the government is also a valid document.

I work for Government institute, should I inform same with gazette notification to head of the institute for inclusion of surname?

You have to apply for change of name in your employment or service records attaching the copy of the gazette publication.
