• What is 'B Final Report' - my name is being mentioned in PCC even after the case was solved

Good Evening,
 An FIR was lodged against me under section 509 and IT act, This was by then would be father-in-law, here I call him Mr. X, who received some vulgar messages on fb about his daughter from my ID. Later they realized my social network ID and Password was misused by some third person. 
My case was solved after the Police submitted a 'B Final' report and the court of law accepted the 'B Final Report'. ( And by the way I married the same girl and we happily living together)
 my questions are ..
1) what is 'B Final Report' is it same as 'B Summary'? 
2) 4 years after the case was 'B Finalized' I applied for PCC for my new job, However in PCC they mentioned that 'i was involved under cr no... under section 509 and IT act and also the B final report was accepted by the court of law'.. Is it OK for me to accept this PCC with such notes from Police or should I ask for a clear report. 
3) Why my name is being mentioned in PCC even after the case was solved. How long the Police will have this in my record.? What is the procedure to get my name removed from the police records?

Hello, as regards the B Final Report, well that is the B portion of the report submitted by the police which is called as final report and when they say it was accepted by the court, it would mean that if the police has given u a clean chit, the same being accepted by the court, the case would then be concluded either in acquittal or in ur discharge at the initial stage itself.

now, it would be beneficial for you to get that the case was registered mistakenly and as clean chit was provided to you, you were discharged. you may insist for the copy of the final report and the final order of the court accepting the final report submitted by the police.

But summary report states that after investigation it was revealed that it was false and malacious case against you. No evidence was found against you. Yes b summary and b final is same. Your PCC says that the FIR was filed but magistrate accepted your b summary report and offence against you doesn't stand.

Don't worry such mention will not affect you at all. There is no such time mentioned in law for removal of Police records.

Ans. Yes, it is. If investigation find that no offence can be made out such complaint against the accused then such reports will be filed. Usually the police used file three types of reports:

a) that is Charge Sheet if any case is made out.

b) If no case is made out

c) If accused is not traced out, the investigation will kept in abeyance till accused is traced out.

Ans. POLICE CLEARANCE CERTIFIACTE (PCC). Once the B final report is accepted the police should not have mentioned the same in PCC. It is nothing mischievous act of police to give you some trouble.

3) Why my name is being mentioned in PCC even after the case was solved. How long the Police will have this in my record.? What is the procedure to get my name removed from the police records?

Ans. Police manual speaks lots of things but they are not following. Two options are left you, either to pursue the Passport authorities or any other authority to ignore such mentioning or approach the High Court with a request to delete such mentioning in PCC. The HC happily issues such directions, nothing to worry.

1. it is closure report and once it is accepted reopening of the same case is almost impossible.

2.Yes, The report of PCC is perfectly alright. If it was not mentioned then it would have been a suppression off act.

3. It is mentioned because you were prosecuted once. it does not mean you are a convict. Howeevr you may insist to reflect the closure of the case as well in the Report.

Accept the PCC with notes from Police

2) B report is wherein case is found to be false and there is no evidence against accused

1. B report means cancellation report i.e police has not found any evidence against you to file a chargesheet and seek your trial.

2. Despite the filing of B report and its acceptance by the court the fact that a criminal case was registered against you will still show up in police records. So police is bound to relay this information when sought from it. The name cannot be removed from police records.

1. 'B' report is the closure report after investigation made.

2. Accept PCC and you may need to attach the same when you disclose your 'Arrest' details when you fill Employment form ( HR form ) . Generally PCC required for 'BGV' check.

3. You can not remove your name from the police records.

Mentioning this case in the PCC will not have any negative impact on you since it has also been mentioned that B final report was accepted by the court.

1.Yes. both are same..

2. A clear report without observation will always help.

3. It will be there forever. You cannot remove once you have been arraigned as accused. But, in clearance certificate, police can give without remark. Approach high court to get a direction.

Dear Client,

If u have been given clean chit by police than FINAL REPORT (FR)shall have filed in the court which mean closer report as no case made out or false case. F R may address B Final report in ur state. SHOW REPORT.

In PCC, it is necessary to give detail of any cognizable case filed and conclusion, AND in ur case clean chit for no case made out, so nothing to worry about.

These reports are known as forwarding reports. (3) Section 173 requires a final report of the police officer as soon as investigation is completed to the Magistrate. The report under Sub section (2) of Section 173 is called Completion Report also known as the Charge Sheet. Such a report is absolutely necessary.

B Summary:

Where a magistrate classifies the case as maliciously false

When there is no evidence or prima facie case against the accused

Applicable when false and frivolous case are filed

A B summary report is filed by the police in such a manner

usually a final report

will lead to acquittal of the accused upon acceptance by court

The police have to become the complainant and register a case against the original complainant stating that he had complained to the police with malicious intent
