• Mother's surname on passport

I am recently married. My wife has two children from an earlier marriage. She is applying for the passports of her children (my step children), who will continue to use their biological father's surname. 

My question is what surname should appear for my wife in "Mother's name" section in the passport for my wife - my surname since we are now husband and wife, or her surname from the previous marriage, or her maiden surname?

1.There is no law which rescribes to use surname of husband only.

2.So your wife can use her maiden surname,her ex- husband's surname or even your surname.

3.To avoid complications she may continue to use the surname which is reflecting in her passport.

4.So depending upon the convenience she may choose her surname.

Yes, first of all she has to apply for renew the passport as she married with you and filed the marriage certificate and divorce decree from previous husband and then she can change her surname in her passport and then she may apply for renewal of passport of the children and mention her updated name

First of all she has to change her surname in her passport by changing your name as her surname. Then in her children passport, who were born through her former husband, she may use the same name (changed surname) which is available as per her passport, at he column of mother. She need not to use her former husband name as her surname in her children passports.

She has to update the current changes in the passport before the application of the passports of the children because the copy of the new passport will be attached with the application.

Even if the previous sir name is reflected then also the same will not create any problem, there is no law that mandates that the wife shall change her sir name after the marriage, if the name is not changed then also the same will not make any problem. However, if the previous marriage has been dissolved I would advise her to either use her maiden name or your you sir name.

On the basis of your marriage certificate, you wife may get her surname updated on her passport.

Post this, she may apply apply for the passports of the children using her updated surname.

1. For applying for the passport of the children of your wife, it is not necessary for her ton first update her passport.

2. She can apply for the passport of her children mentioning your surname as her surname while mentioning their surnames as per their biological father's surname.

3. In case of any query by the passport authorities, submission of copy of her latest marriage certificate will suffice.

There is no law mandating a woman to adopt the surname of her spouse after her marriage.

She is at liberty to change her surname and she cannot be forced to adopt the same.

As per law, if she want to adopt the surname of her spouse, she has to scrupulously follow the procedures for change of name and there is no specific rule or law for changing the surname

Thus it upto her to chose whatever surname she would be comfortable with.

Her children can have the surname of their biological father till the time they have not been legally adopted by you.

They can have their biological mother's surname too, there is no legal infirmity in it

It is again a name that is given to the children by their parents.

There is no rule about surname or law governing it.

Hence it yet another name hence it will not make any difference
