• Marriage with Pak citizen

Hello.
I am an Indian national and currently reside in Japan.
I intend to marry a girl from Pakistan here and then settle down in India for good as she is willing to change her nationality.
Is "long term visa" process very complicated? Can we be optimistic of getting it? What is the success rate? Are most cases accepted or denied? What documents would she need to apply for LTV?

if your Pakistani girl friend is hindu , sikh , Buddhist , jain , parsis , Christian she can apply for grant of initial LTV for a period of 5 years at a time,

A visit visa can only be granted to a Pakistani national who does not have a resident or occupation in India and whose sole objective of visiting India is recreation, sightseeing, casual visit to meet friends and relatives etc. No other activity is permissible on a visit visa. A visit may be issued normally six months with multiple entries and is non extendible and non convertible. The duration of the visa is the sole discretion of the Authority.

you can marry in Japan with your Pakistani girl friend under provisions of foreign marriage act

2) it is better you approach indian embassy in japan in this regard

4) in the alternative you can marry in India under provisions of special marriage act

5)) In case a marriage between an Indian and a foreign national is to take place in India, generally its required to file a notice of intended marriage with a Marriage Registrar in city wherein your marriage will be solemnised

6)That notice is required to be published for the stipulated 30 days. At the end of the 30 days the Marriage Registrar is free to perform the marriage.

7) The notice of intended marriage can only be given in India, if at least one partner is permanently and the other partner temporarily resident in India.

8) If one partner is residing in a foreign country then the partner who is resident in India will have to fill out the “Marriage Notice” collected from the Marriage Registration Office of his/her choice in India and send it to his/her partner in the foreign country who will also have to fill it out. This “Notice” should then be sent back to the partner in India who will have to re-submit it at the Marriage Registration Office. After the stipulated waiting period of 30 days the marriage can take place in India.

9) Under the Special Marriage Act, 1954 a certificate showing the signatures of the persons married, the registrar and the witnesses will be issued

Since you will be marrying before entering India, your wife must apply for X or entry visa before entering India, off course on the strength of her marriage with you.

She could seen an extension of her visa after entering India and after a specific length of her stay in India, he may apply for Indian Nationality.

Frankly speaking, all of this is a bit complicated and cumbersome, but could be still tried.

Grant of visa depnds on sole dsicretion of the country to be visited.So at thus stage nothing could be said sure.

Seeing the hostility between India and Pakistan long tourist visa is very unlikely.

In medical emergency cases such visas are granted for Pakistani citizens.

For registration of such marriage stay of the paKistani citizen is required for at least a month.

1. Where do you want to register the marriage? In India or Jap[an?

2. You can marry at Japan as per Foreign Marriage Act and get it registered before the local Indian Consulate.

3. Getting her spouse Visa will be extremely difficult since she is from our Enemy Country which you shall have to bear with.

4. It also will be difficult for you to get married in India since she may not get tourist Visa being from the Enemy country.

5. You can get married in Japan as suggested above and apply for her spouse Visa for visiting India.

6. If she stays with you as your wife for a substantial period of time in Japan or any other place abroad, Indian authority might consider giving her the spouse Visa to visit India and after staying for more than 7 years in India as your wife, she will be entitled to Indian Ctizenship..

1. In view of the mutual relations between India and Pakistan it is not possible for a Pakistani citizen to obtain Indian visa. Numerous applications are rejected summarily on a daily basis. Let alone getting a 'long term visa' at the threshold it will be an uphill task for her to obtain a short term tourist visa.

2. The prospects of her visa application will be brighter if you first marry outside India and then apply for visa.

Hi,

You need to apply for the tourist visa of your wife and get her marry in India and apply for the X Visa. Visa holders are allowed to live in India for a longer time but they are not allowed to work documents required for the tourist visa are the passport address bank statements return tickets etc. you may check the requirement from the Indian Consulate in Japan.

If required you may give the surety/ sponsorship to her for travel to India.

First of all get your marriage solemnized in Indian Embassy in Japan and get it registered under special marriage act.

Then bring her to India under tourist visa for three months and get it extended by another three months, in the meantime you can visit the FRRO office in Delhi and apply for extension of visa or permanent visa on the basis of spouse.

The procedure when told here wold appear simple but an arduous one.

Can she travel directly to India for marriage or better to get married outside first and then apply for visa?

If you both are residing in Japan now, then you can get married in Indian Embassy of Japan, get it registered under special marriage act and can even apply for visa to India for her from there itself.
