• Buying agriculture land in Karnataka

Need advice on the following.
Me/spouse want to buy agricultural land for agricultural use.
Neither of us have agriculture certificate.
My great-grandfather was an agriculturist who lost his land to tenants in 1974. He did not claim for any money from them. SInce then no one in the family tree has owned any agricultural land.

Is it possible for me to get an AC in my name being a descendent of my great-grandfather by providing proof of family tree/ birth certificate?

) Section 79 (A and (B) of the Karnataka land reforms Act prohibits a non agriculturist from buying the farm land in Karnataka.

2) Section 79(A), inserted by way of an amendment in 1974, bars individuals with an annual income of Rs 25lakh and above from non-agriculture sources from buying farmland. The law empowers the revenue authorities to declare such purchase "null & void" and take away the ownership of the land.

3) the amendment empowers deputy commissioners of districts, instead of assistant commissioners, to grant permission for non-agriculturists to purchase agricultural land under Section 80 of the Act.

4) you can apply for issue of AC on basis of your family tree

Hi, Unless and until you get the permission from the Deputy Commissioner you can't buy a Agricultural Land Legally as per the Karnataka Land Reforms Act.

Hi, you can obtain the mutation documents of agricultural land from the tehsildar office in the name of your great - grandfather .. It will proove your agricultural background

A. Prima facie, you cannot buy an agricultural land in Karnataka as anyone of your family members are not personally cultivating at present. However, you may have success in this regard if you establish proof as to your grand father's agricultural proof by providing RTC. At least any one of the family members must be agriculturist before 01.03.1974. No doubt Section 79 B bars for holding an agricultural land by a person who is not an agriculturist personally cultivation the land. Similarly, Section 80 also bars transfer of agricultural land in favour of a person who is not an agriculturist or agricultural laborer or for non agricultural purpose. However, Assistant Commissioner has a power to issue permission to buy a agricultural land for non agriculturist also.

B. You can buy a Plantation land in Karnataka. And also you cannot buy the same unless and until converted the agricultural land from agricultural to non agricultural purpose. However, to run educational and religious institution, you can purchase the same by seeking exemption under Section 109 of the Land Reforms Act.

See for the purpose of getting the AC, first of all you need to have a agriculture land. As per the rules, this is the lists of document to be required at the time of applying for agriculture family member certificate are as follows:

(a) Application Form of Agriculture Family Member Certificate

(b) A copy of proof of agriculture land

(c) Address proof (ration card / passport / driving license / telephone bill / water bill / electricity bill / bank passbook)

You can produce the evidence for the agriculturist family by the means and sources through which you can establish this fact.

The Legislative Assembly passed the Karnataka Land Reforms (Amendment) Bill, 2015, to increase the income limit for non-agricultural sources to purchase farmland from Rs. 2 lakh to Rs. 25 lakh.

The Bill empowers deputy commissioners of districts, instead of assistant commissioners, to grant permission for non-agriculturists to purchase agricultural land under Section 80 of the Act.

You can procure the certificate certifying that you belong to the family agriculturist/farmer etc.

You can apply for the said certificate from the place where your grandfather lived and was doing the cultivation work.
