• Passport applied by single mum

Hi I applied my daughter passport four month ago in jaipur but still there is no response on her application because I am mother and applied without father name and don't want to disclose his name and daughter is living with me and i am fully taking care of her. application status showing its on review under regional office so what should i do next.

you can apply for passport for your daughter

2) only name of one of parents is required as per revised guidelines

3) you dont have to mention name of father as you are single mother

According to NEW PASSPORT RULES 2017 announced by the Ministry of External Affairs,

--- The following policy changes have been made inter-alia on the basis of the recommendations of the Committee:

(i) The online passport application form now requires the applicant to provide the name of father or mother or legal guardian, i.e., only one parent and not both. This would enable single parents to apply for passports for their children and to also issue passports where the name of either the father or the mother is not required to be printed at the request of the applicant.

Old Rule: While applying for the passport providing names of both Father and Mother are mandatory and both the names will be printed on the passport.

New Rule: Easy form application for the single parents seeking passport for their children. Single parents may also file a request for not printing the name of the father or the mother on the passport.

Authorities cannot insist upon mentioning the name of one's biological father in passport as mother's name is sufficient in certain cases where she is a single parent, the Delhi High Court has said.

"In the absence of any provision making it mandatory to mention the name of one's biological father in the passport, the respondents (passport authorities) cannot insist upon the same," Justice Manmohan said.

The court also took note of the fact that families of single parents were on increase due to various reasons "like unwed mothers, sex workers, surrogate mothers, rape survivors, children abandoned by father and also children born through IVF (in vitro fertilisation) technology".

"Consequently, this court is of the view that mother's name is sufficient in certain cases like the present one to apply for passport, especially as a single woman can be a natural guardian and also a parent," it said.

The order came on a woman's plea seeking re-issuance of her daughter's passport without insisting upon her father's name being mentioned in the application.

The woman claimed that she was divorced from her husband, who had refused to accept her daughter as she was a girl. She said she was a single parent since her daughter's birth in 1997.

She contended that insistence of passport authority on mentioning father's name in the application was violative of the rights of her daughter to determine her name and identity.

The woman also said that entire record of her daughter, including her educational certificates, did not bear the name of her father and the passport authority had in 2005 and subsequently in 2011 issued a passport without insisting upon the father's name.

The counsel appearing for regional passport officer told the court that computerised passport application form has a column regarding father's name and it must be filled.

The court observed that authorities can insist upon the name of biological father in the passport "only if it is a requirement in law, like standing instructions, manuals etc".

Regarding the contention raised by the passport authority that computer would not accept application form without name of father being filled up, the court directed them to modify their software saying, "technology is intended to ease and facilitate transactions and cannot be the basis for creating and defeating anybody's legal rights."

It also noted that on previous two occasions, passport was issued to the girl without insisting upon her father's name and it was "evident that the said requirement is not a legal necessity but only a procedural formality".

As per the recent revised guidelines you have the right to apply for passport without disclosing the name of the father.

Your affidavit to this effect will be sufficient.

File an RTI to check with the status of the passport.

Please refer to Notification dated 23 December 2016 by Ministry of External affairs.

Vide this notification, it is sufficient if you have applied for passport with only the name of the mother. It is no longer mandatory to submit the father's name in passport.

Seek the status of your application under RTI Act.

Under the new guidelines, if you are a single mother, you can apply for your daughter's passport after furninshing an affidavit as to this effect.

If nothing works, file a writ against the Regional passport Officer and seek a writ of mandamus.

In a major relief for single parents, and also separated couples or abandoned wives, the Ministry of External Affairs has made it easier for them to apply for a passport without the burden of providing additional paperwork. A passport applicant henceforth need to provide the name of only one parent and not both for getting a passport made.

Incidentally, several courts had also prior to that episode ruled that one parent’s name was sufficient for the purpose of getting a passport made. The Delhi high court had in May this year noted that a mother’s name was sufficient on a passport as long as she is a single parent.

The ministry has also brought down the total number of annexes prescribed in the Passport Rules, 1980, to nine from the present 15. Annexes A, C, D, E, J, and K have been removed and certain Annexes have been merged. Moreover, since the applicants used to face a lot of difficulty in getting these documents attested or sworn before “Notary/Executive Magistrate/First Class Judicial Magistrate”, the provision has been removed. From now on, “all the annexes that are required to be given by the applicants would be in the form of a self declaration on a plain paper.”

You may take an appointment with the authorities and get the issue solved on the basis of the latest amendments to the issuance of the passport.
