Hello Sir/Mam, I want to know the expense criteria, My Property is rented out in noida, but the tenant misbehaving after the possession. I have registered agreement for 5 years with Noida Authority there is also a point in rent agreement, If I as a landlord need to vacant the premises than I and tenant can give one month notice in prior. I have also try to provide him a notice but he refuse he said to registered post he is not live there or he is not available there. I want to know about the court case procedure for this issue. Is there any court fee that i have to deposit in court from rent (%) percentage or any other fees and process. Please Suggest.....

You will have to file a summary suit. The court fee will have to be deposited as per the rent and you can also file the case by filing partial court fees.

there is nominal court fee if suit is other than money suit. if you did not claim unpaid rent and only claim his eviction then you have to pay nominal fee i.e. rs 200. if you also want to claim unpaid rent then you have to pay court fee in proportionate to the unpaid rent.
