• Writ application by RMC

We are Residents Welfare Association (RWA) effected by Ready Mix Concrete (RMC) unit pollution. Based on RWA complaints Polution control Board (PCB) issued closure notice of RMC as all requirements not completed.

RMC requested PCB to withdraw closure letter as most of the requirement completed and filed writ application with honorable HC Karnataka to direct PCB

RWA knows all the requirements by RMC not completed, can RWA implead itself in writ application or wait for HC order.

From the facts mwntioned by you it seems that There is no such requirement for impleadment, still if RWA happens to be the effected party then they can file the impleadment application at any time before next date of listing.

Yes, you can implead if the judgement of the High Court in this Matt is likely to affect the RWA.

1. If RMC has not made the RWA as a party then latter is free to file an application for impleadment as it is going to be affected by the outcome of the writ petition.

2. Do not wait for the HC order.

It is the duty of RWA to establish prima facie evidence in the court as well. So, RWA should implead itself in writ.

Yes the RWA can file a petition to get itself impleaded in the writ filed by the petitioner against the PCB and express their grievance since they were the original complainants before the PCB
