• CAW complaint

My wife has filled a case against me at CAW. I am not sure if it is a true case or just a hoax. How can i clarify in that? 
How much is the fees a lawyer charges in Delhi if he is fight the case at CAW? 

Kindly advice.

Yes it may lead to an FIR against you, you will probably be required to get an anticipatory bail in the matter, but we will have to see the contentions of your wife in the CAW complaint.

4) if it is genuine case police would call you to attend police station and you can seek copy of complaint filed against you

You need AB only after FIR is filed against you

2) there is no automatic arrest if FIR is filed

Immediately file an application under RTI and get the same or you can get the same through any lawyer.

If the FIR has been registered against you under section 498A/406 of IPC then you should try to get A.B. and then fight the case on merit.

Sir,till now it's only a complaint in the women cell .. If the investigation officer find out any offence during the investigation ant through the evidence given by your wife , he may register FIR.. The lawyer fee varies individually..The fee for appearing on your behalf and providing assistance during investigation will be 25000/-..

Dear Concerned,

Please be informed that registering an FIR in 498A cases is not that easy these days - especially after the 27th July 2017 judgement by the Hon'ble Supreme court.

Hence subject to your / your representatives participation in the CAW proceedings - you may choose to ignore / reply to the complaint that has been filed by your wife. If you choose to Reply to the complaint - there are very high chances that the case will not be registered at all.

TO comment further on the matter it is important to understand the current status of the complaint. NO AB is not required if FIR has not been registered. Also do be misguided - do not apply for AB - if FIR is not filed.

1. How did you come to know that she has filed a case against you before the CAW?

2. If you have been issued with a Notice, then by visiting the CAW you can get copy of her complaint from where you shall be able to make out the auhenticity of her complaint.

3. You are required to attend to the hearings on the scheduled dates in person or through your Advocate/Representative.

4. Professional Fee varies from Advocate to Advocate and from place to place.

1. Do not miss the next hearing as if you do not appear before the police even after getting notice, they will conclude their investigation and may lodge FIR against you.

2. If FIR is registered against you, you shall have to apply for and avail Anticipatory Bail and contest the case fittingly.

Without getting a summon or notice from CAW cell, why do you become anxious about the possible case by her.

A complaint before CAW cell shall begin with mediation hence you may not take the assistance of a lawyer in the initial stage itself,

If the CAW cell is unable to mediate and find solution to this issue they may either advise the complainant to approach court or may deviate the matter to regular police, after which you may require the assistance of a lawyer.

The lawyer's fee cannot be predicted.

I could not make it to the first 3 hearings and for the lst one she also did not appear as i had authorised somebody on my behalf to go and get me the case copy but they said both the party and the ACP are not availabe. But thru one of her relatives i have understoof that she has filled for harrasment and istridhan? Can it lead to a FIR against me and do I need to get AB before hand

If her grievances are over the Stridhan alone, why dont you arrange to return her articles to her through the same CAW cell.

This step would bring a solution to the complaint filed by her, if not then the matter will be referred to the police and they may register a FIR under section 406 IPC, in that event you may have to obtain AB.
