You can remarry after period of 3 months of receipt of divorce decree
In the event your wife files any appeal against the divorce decree you cannot remarry during pendency of appeal
After Judgement (Court) order should I remarry soon
My divorce is taken place, all the court procedure is now over I have also transferred final alimony amount. Within next week I am getting the Judgement Order letter from court. But Divorce Decree will be issued by court after 4 Months (Say December - 2017). I just want to know, after receive the Judgement order letter from court can I able to remarry even though Divorce Decree not received. In simple word I want to know from all respected Advocates from Kaanoon.com that before December - 2017 can I remarry on Court Judgement Order. And if after receive Court Decree, can I remarry soon ? Requesting to all Respected Advocates to please solve my query, I am very much in confusion. Thank you very much in advance.

1.The bar on remarriage on decree of divorce is for 90 days from the date pf passing of judgement.
2. So it has nothing to with the receiving of the copy of the judgdement.
3.So do not fix the date of remarriage before expiry of 90 days from the date of passing of decree.
Dear Querist
You divorce has been granted by the court under mutual consent divorce under section 13(B) of Hindu Marriage Act or contested divorce under section 13(1)(ia) or (ib) of Hindu marriage act?
If under Mutual consent divorce then you can remarry immediately after the judgment and no need for any decree for the same.

I do not get that if the divorce has been decreed then why the court is giving you the copy of the order after 4 months.
Let me know the content of divorce order for concrete advise. if alimony has been given then you can marry immediately after divorce is decreed.

1. 90 days is the time limit to appeal the decree. So you must wait for 90 days period to expire.
2. After the expiry of 90 days you can marry on the 91st day.
If this divorce is by a contested case and the decree passed after hearing both the sides then you may have to wait for 90 days from the date of judgment (date of receiving the decree copy) for getting remarried.
The 90 days is the period of limitation for preferring an appeal before high court against the family court judgment
