I am a single male and i want to adopt a girl child. I want to know that "is the hindu adoptions and maintainence act is applicable now"??? Thats the only act that allows single male to adopt a girl child.

THE HINDU ADOPTIONS AND MAINTENANCE ACT, 1956 allows unmarried Hindu male and female to adopt a Hindu girl child or a Hindu boy child upon fulfillment of the following conditions:

I. GENERAL CONDITIONS TO BE ELIGIBLE TO BE AN ADOPTIVE PARENT

Unmarried males:

Should be of sound mind

If adopting a Hindu girl child, age difference should be 21 years.

Should not be a minor

Has the capacity to take a son or a daughter in adoption.

3) . A single man desiring to adopt a child may be eligible if he applies through a registered agency. However, he will still only be able to adopt a male child.

In India, Adoptions are comes under the following laws;

1. The Hindu Adoption and Maintenance Act of 1956

2. The Guardians and Wards Act of 1890 and

3. The Juvenile Justice (Care and Protection) Act of 2000, amended in 2006

A single female or a married couple can adopt a child. In India, a single male is usually not eligible to be an adoptive parent. A single man desiring to adopt a child may be eligible if he applies through a registered agency. However, he will still only be able to adopt a male child. Adoption laws are common across India and must be distinguished from guidelines followed in adoption procedures, which do differ from one state to another.

A single parent may adopt under under the Hindu Adoption and Maintenance Act of 1956. However under the current regulations, a single male is not eligible to adopt a girl child.

(If he is married then he has to obtain consent of wife)
