• Mental harassment by wife

Hi
I have been married for 6 years & having kids.After 6 months of my marriage my wife started mental harassment.Fighting with small issues & even some times she is creating dummy issues to fight with me.Now she is harassing my parents too.My mother in law is giving fuel to that.Always after fight my wife used to say give me divorce.I don't want to give her divorce as it will damage my kids life.I want to get rid from this mental harassment.Can you please suggest me suitable steps?

Hello,

Sir you can not get rid of this mental harassment without getting rid of the relationship, if you want to continue the relationship and you just want this harassment part to get over, it is advised that you consult some elderly member of the family who can make you understand the things and then can try to solve the issue. There is no legal solution to the fact that she is causing mental harassment.

You have only two options, either to live with this or to take steps for dissolution of marriage. If you do not wish to take divorce, seek help of a counsellor. Seek guidance as to how to have a healthy relationship in your married life. Things in your case can be resolved only mutual discussion sessions. You may also take assistance of a mediator.

2. So, for getting relief, either your wife should change her behaviopur or you change your wife by divorcing her.

3. There can not be any other way to solve your stated problem.

1. First of all you shall can not prove that your mother in law is instigating your wife to misbehave with you. Moreover, an adult lady like your wife should not be carried away by some one's instigation to misbehave wityh her own husband.

Try to settle the matters with close relatives or common friends. Most probably lack of conversation, ego,misunderstandings etc are are the main villan.

Consult your wife with a physiologist for solving the issues .Also handle her with at most care and intelligently.

first of all you should try to find out the reason for such behaviour. If she is abusive, record that too. first of all sit with her and talk to her about everything you feel about her behavior and attitude. Instead of getting rid of her try to get close to her. if she is behaving like that there must be some reason ask her what she wants to do it is possible that she may give you some clues and after getting clues just try to find out the solutions, discuss with her only to remove differences between both of you, because the fight between both of will ultimately affect your kids career and mental condition.

Second option if after making all the efforts you won't succeed then you can approach a advocate for divorce, and definitely there must be some way to work out with all this issues.

1. If you want to get rid of the marriage then you have to file a petition for dissolution of marriage on the ground of mental cruelty.

2. If you do not want divorce then propose counselling through a marriage counsellor to your wife.

1. if you did not commit any mistake that can form basis of divorce then your wife cannot get divorce without your consent.

2. section 13 of the hindu marriage act is based upon guilt theory. unless and until guilt of respondent is proved by the petitioner, he cannot get divorce.

3. if your wife files suit for divorce, she is bound to prove your guilt otherwise she cannot get divorce decree.
