Whose and all signature required in the sale deed and how we can identify that document is absolutely
ok . i am buying property in loan when can in do the registration as the building is still in construction . The Builder said me it will be only done after the completion of the building at the time of possession . is he said rite .

please suggest me the same .

Hi, The person who is the absolute owner of the property he can only sale the property to you. We have to verify the documents then only we can able to tell who is the owner of the property. It is better you can consult any advocate who will guide whether the property you have purchased is genuine one or not.

2. As far registration of the property you have to wait till the completion of the building other wise once he registered the property thereafter builder has fail to complete the building then you are in trouble.

Yes the title will be transferred on your name when the construction of the building is done and it can not be done before it. You and someone on behalf of the builder will sign the sale deed in presence of two witnesses before the registrar office.

The builder is correct. He cannot handover the possession to you and execute the sale deed in your favour until he obtains occupation certificate from the concerned Authorities. The sale deed will be executed by the Authorised representative of the builder in your favour. The document will be executed in presence of 4 witness, 2 from your side and 2 from the side of the builder.

The land owner of the property must sign the sale deed in order to convey or transfer the same in your favour. Apart from this, if the land owner has given his property for Joint Development then the builder/developer as his attorney must also sign the final deed of sale.

Final registration will be done after the building is ready and once the flat is ready for possession.

1. Seller's signature only, if it is his self acquired property. Signatures of 2 witnesses are a must.

2. If it is an ancestral property, the signatures of all legal heirs have to be taken.

3. To know whether the document is legally O.K., get the document verified by a Lawyer.

4. You can enter into an agreement of sale now itself and go for the absolute sale deed after the building is ready for occupation.

Are you buying the property from the builder or from the buyer who has already entered into a sale agreement with the builder.

If that is the case then it is better you enter into a tripartite agreement with both of them.

The registration of property in your name shall be done only at the time of handing over possession,
