Hello sir,
 A year back we bought a land in Bangalore which is B.Khata .we have got a legal opinion also which says everything is clear. My land number was given as 58/1 which is in layout..when we went to clean our property,the neighbour guy told us that our land is supposed to be road.the layout which he as shows it..
* Towards left side of our plot the number is 58
 Right side it is 59
 Back side it is 74/1
1.why our plot is given with /1..not a whole number
2.Is there any problem in future after house construction

1) apply to directorate of survey and land office to carry out survey of your land

2) then request seller to execute deed of rectification to correct the survey number of your plot

1. Obtain Encumbrance Certificate for your property from the Sub-Registrar's Office.

2. Get the site number 58 surveyed by a Government authorised Surveyor.

3. Contact the seller of your site and ask him to clarify the position.

4. Show the papers to a Lawyer.

5. Contact BBMP and take their help in solving your problem.

Go to the registry and check the encumbrances, the legal opinion that you are talking about has been given to you after checking the land records or not?

And if it has been given to you after checking the land records and still you are in a doubt then I suggest you to kindly ask another lawyer to check the land details of last 6 years.

It seems from the above, you took a legal opinion before purchase of the property. Why your land is numbered as 58/1 will be forthcoming in a document known as the Phodi Extract which will reveal why and when the land was bifurcated or phodied as 58/1 sub number 1, and in support of this the entire land 58 will be shown as survey sketch from the Assistant Director of Land Records. If this document is forming part of the legal opinion then you have nothing to worry. Otherwise you will need to revisit the documents once again with an expert and take a second opinion to put your fears at rest.

Hi, First you have to identified your property either through the Surveyor then after identification you can proceed further.

2. As in your case, someone has told you that this property is not yours and he has not claim the property of yours. it is better you can put the compound there and take the possession of the property and if some one has claiming the property then you have to move the court for suit for bare injunction.

First of all it is B khatha land hence you wont find proper location also or the authenticity itself would under stake.

Did you get opinion in writing from the lawyer?

Why did you not raise the question about the land number as 58/1 etc from the vendor.

Even now you may ask the vendor to identify the land as per the number allotted to you.

If he refuses then you may lodge a criminal complaint against the vendor for cheating you by selling a non-existent plot

EC will not give clear picture about this.

You can ask your vendor to identify the property sold to you in view of the confusion and the claim by neighbor.

Otherwise you may have to apply for survey by a government surveyor through the Tahsildar within the jurisdiction to ascertain your property based on the survey number.

If there is a wrong survey number then yo may have to go for a rectification deed to rectify the correct survey number.
