I am a U.S. citizen. My partner lives in india and is a indian citizen. We want to get married in india. What is the process including steps to take, documents needed, and when do I being the u.s. citizen need to be present in india for the process. I am concerned about traveling back and forth. I have never understood the process so I am asking for a detailed explanation

Your marriage has to be solemnised under the provisions of special marriage act as you ate a US citizen 

 

2) 30 days notice of intended marriage has to be given to marriage registrar In the district in India where your partner has resided for at least 30 days.

 

3) The 30-Day Waiting Period: The Registrar publishes a public notice. A 30-day waiting period begins, during which objections can legally be raised by the public.

4) Solemnisation and Registration: After the 30 days pass (and if there are no valid objections), you, your partner, and three witnesses appear before the Marriage Officer to sign the marriage register and solemnise the union

 

5)You must travel to India to visit the Sub-Registrar’s office alongside your partner to sign and submit the Notice of Intended Marriage. Once filed, you can legally fly back to the United States.

 

6) You can return to the U.S. or go about your life while the 30-day statutory notice period runs in India.  You fly back to India after the 30 days are complete to appear before the Registrar with three witnesses, sign the final papers, and receive your legal Marriage Certificate

For the U.S. Citizen:Valid U.S. Passport and Visa (or OCI card if applicable).

Single-Status Affidavit / No Impediment Certificate: An affidavit sworn before a U.S. notary stating you are legally free to marry (unmarried or legally divorced), which is then apostilled by the Secretary of State in your U.S. home state.

For the Indian Citizen:

  • Valid ID and Age Proof (Aadhaar card, PAN card, or birth certificate).

  • Address Proof in the local district.

  • Passport-size photograph

Assuming both of you are Hindus, you may very well get your marriage registered upon your religious wedding ceremony. Your passport, your partner's ID and address proofs, wedding invitation and pictures taken during the wedding ceremony, the priest who conducted the solemnisation, and two witnesses, besides parents from both sides - these are good enough for registration purposes.

The marriage between and Indian citizen and a foreign citizen has to be registered under special marriage act in india.

Before submitting a marriage application, at least one partner must reside in the local jurisdiction of the Marriage Registrar for a minimum of 30 days. Since your partner lives in India, they fulfill this residency requirement. You do not need to be in India for this initial 30-day period.

Your partner can submit the Notice of Intended Marriage before the local registrar.Some local registrar offices allow the local partner to submit the notice, while others require both partners to sign in person. If your local office allows it, your partner can file using notarized copies of your documents. Otherwise, a brief trip to India is needed to submit the notice.

Once filed, the Marriage Officer posts the notice publicly in their office for 30 consecutive days. This period allows anyone to submit legal objections to the marriage.

If no objections are filed within 30 days, you and your partner have 90 days to finalize the marriage before the Registrar. You must be physically present in India on the day of registration.You, your partner, and 3 adult witnesses sign the marriage register at the Marriage Officer's office. You will be issued an official Marriage Certificate.

 

Key Required Documents for the  U.S. Citizen are:

  • Valid U.S. Passport & Tourist Visa (e-Visa or regular paper visa).

  • Proof of Single Status / No Objection Certificate: A sworn Affidavit of Single Status affirming you are legally free to marry. This can be notarized in the U.S. and apostilled by your state's Secretary of State, or executed at a U.S. Embassy/Consulate in India.

  • Birth Certificate (with an Apostille if requested by the local officer).

  • Divorce Decree / Death Certificate (if previously married) with an Apostille.

  • Passport-sized photographs.

For the Indian Citizen:

  • Valid Indian Passport or Aadhaar Card.

  • Proof of local residence (Aadhaar, Voter ID, Utility Bill, or Passport).

  • Proof of Date of Birth (Birth Certificate, 10th-grade Marksheet, or Passport).

  • Passport-sized photographs.
