I am a Canadian citizen with OCI card as the only Indian government issues ID. Want advise on how to give GPA to my uncle in India for an inherited property .

You can execute a general power of attorney in favor of your relative in India, along with two local witnesses, you can get it attested by an official of Indian consulate at Canada, send the hard copy of the GPA deed to your relative in India by a sealed cover, he will then take it to the sub registrar within his residential jurisdiction , the sub registrar will break open the seal and after verification, he may  validate it by adjudicating the same.

Your relative can then perform the tasks assigned in the power deed accordingly.

If you want to execute the GPA deed in favor of your uncle in India, you can get a GPA deed drafted through a document writer/advocate in the local, after you will be informed about further formalities. However you may have to remain and be present before the concerned sub registrar within whose jurisdiction the property falls and sign the registered GPA deed in front of the sub registrar along with the power agent.

1. Prepare GPA in Canada itself or take the services of a professional in India who would send it to you online, so that you can take printout of the same.

2.  Sign the POA and get it attested by a Consulate Officer in the Indian Consulate and later send it to India.

3.  Then let your uncle sign it.

4.  After it reaches India, it has to be got adjudicated in the jurisdictional District Registrar's Office.

5.  After it's adjudicated, your uncle can act, on your behalf, in respect of the property in India.

  1. Draft GPA on white paper, a bond paper is not necessary.
  2. You can obtain attestation of notary public of local jurisdiction. No any attestation of Indian High Commissioner is required. A GPA attested by notary public is as valid as GPA attested by official of Indian High Commissioner.
  3. Send the GPA to the  person  
  4. He will take the GPA to District Registrar who validate the  same by endorsing on GPA charging nominal fee.
  5. Present the GPA to Sub-Registrar with deed of transfer, your property will be transferred.

You can execute the GPA either from Canada or in India.

 

From Canada:

  • Draft GPA in Indian format.
  • Sign before a Notary and get it apostilled or attested by Indian Consulate.
  • Send original to India.
  • Your uncle must get it adjudicated/registered at the Sub-Registrar’s office where the property is.

From India (if you visit):

  • Carry passport + OCI.
  • Draft GPA and sign before the Sub-Registrar.
  • Registration makes it immediately valid.

Note: Registration is mandatory for property GPA. Passport + OCI are enough; Aadhaar/PAN not required.
