You should execute specific power if attorney in favour of uncle to sell the property
it should be attested before Indian consulate
You can execute a general power of attorney in favor of your relative in India, along with two local witnesses, you can get it attested by an official of Indian consulate at Canada, send the hard copy of the GPA deed to your relative in India by a sealed cover, he will then take it to the sub registrar within his residential jurisdiction , the sub registrar will break open the seal and after verification, he may validate it by adjudicating the same.
Your relative can then perform the tasks assigned in the power deed accordingly.
You do not have to visit India for this purpose, you can complete the execution of the proposed general power of attorney deed from Canada itself.
Since you are residing in Canada, you can do it at Canada itself, or if you happen to visit India for any other purpose, you can get this task completed in India also.
If you want to execute the GPA deed in favor of your uncle in India, you can get a GPA deed drafted through a document writer/advocate in the local, after you will be informed about further formalities. However you may have to remain and be present before the concerned sub registrar within whose jurisdiction the property falls and sign the registered GPA deed in front of the sub registrar along with the power agent.
You can contact an advocate either from this website or outside over phone and get all issues clarified personally if you are not able to post them here in this public forum
1. Prepare GPA in Canada itself or take the services of a professional in India who would send it to you online, so that you can take printout of the same.
2. Sign the POA and get it attested by a Consulate Officer in the Indian Consulate and later send it to India.
3. Then let your uncle sign it.
4. After it reaches India, it has to be got adjudicated in the jurisdictional District Registrar's Office.
5. After it's adjudicated, your uncle can act, on your behalf, in respect of the property in India.
As a Canadian citizen with an OCI card, you can execute a General Power of Attorney (GPA) in favour of your uncle in India for managing your inherited property, and this can be done either from Canada or during a visit to India.
If you wish to execute the GPA from Canada, the process is as follows:
Draft the GPA detailing the powers you wish to grant (sale, management, litigation, etc.)—preferably with a legal expert’s help.
Sign the GPA before the nearest Indian Consulate/High Commission; your signature will be attested by the consular officer.
After attestation, courier the original document to your uncle in India.
Your uncle must then have the document adjudicated and stamped as per the Indian state’s stamp laws (usually before the district registrar/sub-registrar), after verifying the signature and attestation.
If you are able to visit India:
You can execute and register the GPA directly before the local sub-registrar in India, using your OCI card and Canadian passport as ID proof.
Your physical presence makes the process faster, as the GPA is usually registered the same day.
Key Points:
The GPA is valid only as per the authority you confer and must be registered at the sub-registrar’s office if it relates to immovable property (as per Section 17 of the Indian Registration Act).
For sales/transfer of property in many states, the GPA must be executed by the owner and registered.
Banks or officials may require additional KYC verification if the property is later sold.
Our services can be engaged to review the draft, guide you through the attestation process, and ensure registration in India. This advice is based on the information provided and is protected under attorney-client privilege.
You can execute the GPA either from Canada or in India.
From Canada:
From India (if you visit):
Note: Registration is mandatory for property GPA. Passport + OCI are enough; Aadhaar/PAN not required.
Yes, a Canadian citizen with OCI can execute a GPA (General Power of Attorney) for property in India either from Canada or during a visit to India.
From Canada: Sign the GPA before a Notary, get it attested by the Indian Consulate. Then send it to India for registration with the local Sub-Registrar.
From India: Sign and register the GPA directly at the Sub-Registrar’s office.
In both cases, the GPA must be stamped and registered in India to be valid for property matters.
