• Property land selling issues due to neighbour

We have a residential plot in Kerala which we are trying sell.Unfortunately our neighbour who is currently living on rent is spreading rumours about our plot that there is ghost seen in the plot and due to which many potential buyer refrained from going ahead.
There intention is to get our plot at a dirt cheap price if we are unable to sell to anyone.
I am not sure if there is any solution where we can send an official notice to the neighbour or take help of local police to stop them spreading any rumours.

There is solution in law for every problem. An offence  under Section 508 of inducing person to believe that he will be rendered an object of the Divine displeasure is committed by your neighbour. Ghost will cause harm to buyer is the essence of offence. The offence  is punishable with imprisonment up one year. File a complaint in the Court Magistrate against him listing the persons as witnesses who heard him say so.

You should send a legal notice to your neighbor asking him to restrain from doing such activities amounting to an offense of mischief. In case he fails to respond, you can then proceed to file a complaint at the nearest police station.

If you have concrete evidence to prove that he is spreading such false rumours for wrongful gains and if he is not stopping his mischief despite your requests, you can resort to legal action.

you may give a complaint to the police station about his such undesirable acts, illegal activities of spreading false rumours in the name of ghost etc in order to stop you from selling the property to the prospective buyers along with one or two witnesses from your side to confirm your complaint.

The second option is to send a legal notice to him instructing him to refrain from indulging in such illegal activities or to face legal consequences through court of law, after which you can file a private criminal complaint under section 200 cr.p.c. with the support of few witnesses in your side, before the judicial magistrate court.

No doubt these are few legal options before you, but the more effective action would be to be present near the property while the prospective buyers visit the location and convince them the fact of false rumours which may give them confidence and would enable them to buy the property without any fear.
