My name is Amit Naik, 36 yrs, from GOA.
Am married to a Filipina, since 2019.

# We are married in India, but not in Philippines.

# Have a baby girl of 4 yrs.

# Want to register our marriage in Philippines.

# Dont know whether to do it here in India in DFA, or

# Whether it can be done personally in the Philippines.

# Whether it is possible to register our Indian marriage in Philippines itself, as i will be going there at the end of April, or in May.

# Me, n my wife are both seafarers. Am on vacation. Wife is still onboard. She will be coming down on vacation at the end of May.

# Need to apply for the LEGITIMATION OF CHILD for our daughter. Therefore Registration Of Marriage is necessary.

# Major question is about the Registration of Marriage. Whether it can be done in the Philippines, instead of doing it here in India.?

 Reasons being:
1. I will personally be there in the Philippines.
2. Some documents need signatures of both the parents.
3. My wife is currently working.

# In case, Marriage can be registered in Philippines, what documents will i need to carry with me to Philippines.. (notarized, apostilled, etc)

Since you have married a foreigner in India that too long ago,  you may not be eligible to register your marriage in India under special marriage act or foreign marriage act. 

 

For getting your marriage registered with a foreigner in India,  you both need to submit an indent for registration of marriage by complying with the requisite formalities as prescribed in law. 

If you are desirous of getting your marriage registered as per Philippines law,  then you may have to take the legal advice and assistance from an attorney of that country

1. You can register your marriage in the Philippines, even if it was solemnized in India. The Philippine government recognizes marriages that are validly celebrated abroad, as long as they comply with the laws of the country where they were solemnized.

2. You can do the registration personally in the Philippines. You may go to the Philippine Statistics Authority (PSA) office in the city where you will be staying to apply for the registration of your marriage. You will need to bring the necessary documents and pay the required fees.

3. To register your Indian marriage in the Philippines, you will need to present the original copy of your marriage certificate issued by the Indian authorities. You will also need to secure an Apostille or authentication from the Indian Ministry of External Affairs or the Indian embassy in the Philippines, to certify the authenticity of the document. The Apostille or authentication will be recognized by the Philippine government.

4. You will also need to bring your passports and visas, as well as your daughter's birth certificate to establish your identity and your relationship with your daughter. Your daughter's birth certificate should be authenticated or Apostilled by the Indian authorities or embassy.

 You can very much register your marriage under marriage under Foreign Marriage Act, 1969. In every Indian Embassy, Consulate or High Commissioner, there is Marriage Officer where an Indian can register his/her marriage with any foreign national.
