The POA can be prepared and after your mother's signature, let it be notarised/ countersigned by an Indian Consulate Officer and sent it to India for her daughter's signature. Based on this, the daughter would operate and close the locker.

Then the daughter can sign along with her mother and then it can be notarised/countersigned by the Indian Consulate Officer. The daughter will carry the POA and get it adjudicated in the jurisdictional District/Sub Registrar's Office in India.

Thank you Sir/Madam.

She can execute a power of attorney deed in the country of her current residence, get it notarized by the local notary public and send it to the power agent mentioned in the power deed.

The particular purpose of this deed should be essentially mentioned in the power deed.

The power agent can approach the bank manager with this deed and her identity card with an application to complete the assigned task.

The power agent can get the locker operated or closed on the basis of this authorisation.

Mother can give power to any other distant relative also, alternately she can authorise a lawyer of her choice and entrust this assignment on the terms of the chosen advocate.

You have to engage a local lawyer in India for drafting POA

2) it has to be on Rs 500 stamp paper and duly notarised

POA is not required to be registered as it is only for closing bank locker

if bank locker was in father name then bank would insist on succession certificate

To grant power of attorney to one of her daughters to operate and close a locker in India, your mother can follow these steps:

  1. Draft a power of attorney document that clearly states the purpose and scope of the authority granted to the daughter. The document should also specify the time period for which the power of attorney is valid.

  2. Get the power of attorney document attested by a notary public or an Indian embassy/consulate in the country where your mother currently resides.

  3. Send the attested power of attorney document to the daughter in India.

  4. The daughter in India should then visit the bank where the locker is held and present the attested power of attorney document along with her identification documents to the bank officials.

  5. The bank officials will verify the document and the identification of the daughter and then allow her to operate and/or close the locker as per the instructions given in the power of attorney document.

It is important to note that the exact process may vary depending on the bank and the specific circumstances of the case.

The POA has to be drafted by a lawyer specific to the purpose of operating the locker and needs to be validly executed in USA(where your mother lives) and attested at the Indian Embassy in US.

Then it will have to be sent to the Agent in India, who can further get it registered in India before the Concerned SDM office.

The POA after registration/franking by the Indian Authorities, can the be put to use at the Bank for operating the locker.

If locker is in the name of mother. If yes then You can get the POA from your mother apostille at Indian consulate and simultaneously communicate with the bank through email or phone.

First get their confirmation and what all documents require from the bank then only visit India.

Dear client,

To grant Power of Attorney for closing a locker in India, your mother can execute a General Power of Attorney in favour of her daughter. The POA can be executed in the presence of a Notary Public, Indian Consulate or any other competent authority in the country where your mother and the daughter reside. The POA document would need to be attested by the Indian Consulate or embassy in that country, and upon its return to India it can be presented to the bank to authorize the daughter to operate and close the locker. Please note that the process may vary depending on the bank and their requirements, so it would be best to check with the bank on their specific procedures for closing the locker based on a POA granted abroad.

- Since, she is old then she can give POA to any relative in India as well

- However, as the daughter is also residing abroad , then she can send the copy of that POA to the bank for closing the locker, if none in India.
