• Marriage between an Indian citizen and a citizen of Ukraine

I have a few questions about the marriage between an Indian citizen and a citizen of Ukraine. 
1. First of all, what kind of visa do I need as the citizen of Ukraine to travel to India, meet my boyfriend and marry? I have heard that people marry on tourist visa and then convert it into entry visa after marriage. However, I have read on the official website of the Embassy of India of Ukraine that tourist visa is not convertible into anything. So what type of visa do I need to stay with my husband in India after marriage?
2. I realize that my documents (birth certificate, passport, etc.) issued in the Ukrainian language have to be translated into English and notarized. But is it necessary to stamp apostilles on the documents? 
3. Lastly, there is the so-called non-objection certificate. I have contacted the Ukrainian Consulate in India and they have suggested me the way to get it, but it is costly and a little difficult because that would require us to travel to another city. Can I obtain an affidavit confirming my single status from the local notary in Ukraine instead of that one obtained from the Consulate? Or it is mandatory to obtain this affidavit from the Ukrainian Consulate in India and that’s the only way?

As per the visa manual, tourist visa can be converted to X2 visa only when the marriage takes place in India and gets registered within the validity of the present tourist visa.

Contrary to that, if anyone wants to do so has to go back to his or her country and come back on X2 visa.

With the amendment of the visa rules and streamlining the process, the conversion of tourist visa to X2 would be allowed even if the marriage takes place on foreign soil.

An Indian and a Foreigner/NRI/PIO can get married in India under the Special Marriage Act, 1954 after fulfilling certain requirements. The parties should send a notice to the Registrar of Marriage regarding the intended marriage and fulfill some ancillary procedures.

1. You may have to obtain X2 visa and not that visit visa can be converted automatically, but you can get X2 Visa after your marriage within the validity period of tourist visa.

1) You can avail for an Entry visa (X) through any of the FRROs in India. This visa doesn't give you any rights to be employed or do business, but you can stay for a long term in India on this visa.

2) Yes, you need to sign and stamp from apostilles on the documents.

3) Its better to get NOC from the Ukrainian Consulate in India.

1. You can come to India on Tourist Visa and then get married to your boy friend in India as per Special Marriage Act. Ask your BF to file an application before one month from your scheduled date of marriage. While submitting the said application, your BF can get all the information from the Marriage Registrar. 

 

2. After your marriage, you can either go back to Ukraine and further apply for spouse Visa or (if you do not want to go back) extend the period of stay mentioned in your Tourist Visa,

 

3. No Objection Certificate can be obtained from your Consulate.

You can convert tourist visa to an Entry get married through Special Marriage Act. Your partner should draft a notarized affidavit undertaking your financial responsibility. The foreigner should give an undertaking that he/she will not seek employment or do business in India and want to convert your visa to spouse visa. You can apply for X visa on E-FRRO Portal of India.
