• Sucess certificate and Share transfer

We got sucession certificate for shares of my parents in the name of A and B. Can transmission application be applied with first name of B and second name of A

1. You shall have to  get the names of your parents be substituted with the names as mentioned in the succession Certificate issued by the Court.

 

2. The substitution will be in joint names of A & B.

 

3. You can apply for the substitution in the name of B & A also if both of them agree.

The word "transmission" means transfer of title by operation of law. It may be by succession or by testamentary transfer. It should be done in the name of A and B only.

The Transmission Request Form should be filled up by legal heirs who would like to have the shares held by the deceased transmitted in their names. 2. The applicants should fill up their names on the Form in the same order in which their names should appear on the share certificates.

Execution of transfer deed not required in case of transmission of shares. Intimation/application of Transmission accompanied with relevant documents would be enough for valid transmission request.

It was clearly opined in my previous post itself which applies to this question too, to repeat:

The Transmission Request Form should be filled up by legal heirs who would like to have the shares held by the deceased transmitted in their names. 

he applicants should fill up their names on the Form in the same order in which their names should appear on the share certificates.

Thus it depends  on the application to be filled accordingly.
