Hello, My wife has applied for a family reunion visa for Germany and one of the main documents is marriage certificate . We did not click any photos in the court premises . What are our options here ? Is it mandatory to provide photos along with SMA certificate ? Can the visa be denied if marriage photos are not provided in case of special marriage act ?

Thanks for your reply . In case marriage photos are not available (because we did not click any pictures inside court premises). Is there a provision in law to arrange photos in present day that would serve same purpose as marriage day photos ? A sworn affidavit for example . Pardon me as I am just a layman in legal knowledge terms.

2) you can approach the marriage registrar office and request him to permit you to click some photos and forward photos with marriage registration certificate to German embassy for visa purposes
Marriage photos does not mean that photographs clicked on the premises of marriage Registrar. It means any photograph if marriage ceremony/function is held. Such ceremony/function can prior or subsequent to registrar of marriage. If you do not have any such photos, your can submit a joint affidavit to that effect supported affidavit any third person who attended the marriage function/ceremony/gathering etc.
- Since the marriage was registered under the Special Marriage Act, then as per requirement of the marriage the marriage photograph is necessary to file with the application before the marriage registrar.
- Hence , if the photographs of the marriage was submitted with the marriage Registrar a the time of registration , then you can take the certified copies of photographs from the office of the marriage registrar dully attested by the Registrar and can submit it for visa purposes.
- Further, some other photograph which showing that you both getting married with each other , and showing that both the couples are husband & wife then it can also be submitted for visa purposes.
- Further , if you both are present in India, then can take photographs after going to marriage registrar as well.

As per the link you have provided it is clear that you have to submit the photographs besides the marriage certificate to prove that the marriage was solemnised as [er the existing conditions as mentioned therein.
The condition mentioned in the link for SMA is

- Certificate of Marriage according to Section 13 Special Marriage Act
- Photographs of marriage or function
They have not insisted on the photographs of signing the register of marriage held wit the marriage officer/registrar.
You may arrange to get a photograph even now displaying the function post or pre registration of the marriage and attach the same to yor application.
It also specifies that:
Submission of the above-mentioned documents does not guarantee that a visa will be granted.
Submission of incomplete documentation or refusal to appear for a visa interview will delay your
application and may result in the rejection of your application.
So now you have to decide whether to abide the rules or not.
You can arrange to take some photographs with the wedding attire and project it as if they were taken at the time of marriage then.
This will not be verified because it is ultimately the photographs of you both, hence the authorities may not probe into the details of the same when you are attaching the marriage certificate also to prove your registration/solemnisation of your marriage under special marriage act.
Marriage pictures are only an additional evidence and are by themselves not conclusive. In the circumstances you have stated, they should accept your averment and waive the requirement. If necessary, an affidavit sworn before a Notary is good enough.
